The City of Grand Island, Nebraska, by action of its City Council on May <br />21, 2002, enacted Ordinance No. 8721 which directed the conveyance of the real estate described <br />below and the manner and terms thereof. <br />2. Ordinance No. 8721 was published in the Grand Island Independent <br />according to law on May 28, 2002, and notice of such sale and the terms thereof was published <br />in the Grand Island Independent, a newspaper published in and of general circulation in Grand <br />Island, Hall County, Nebraska, for three consecutive weeks, on May 29, June 4, and June 11, <br />2002, all as required by Section 16 -202, R.R.S. 1943, as amended. <br />3. No remonstrance against such sale was filed with the City Council of the <br />City of Grand Island, Hall County, Nebraska, within thirty days of the passage and publication of <br />Ordinance no. 8721. <br />4. Section 5 of Ordinance No. 8721 provides that if no remonstrance is filed <br />against such conveyance, the Mayor and City Clerk shall make, execute, and deliver to Robert <br />M. Allen Family Limited Partnership, a warranty deed for said real estate, and the execution of <br />such deed is hereby authorized without further actin on behalf of the City Council. <br />5. NOW, THEREFORE, the CITY OF GRAND ISLAND, NEBRASKA, a <br />municipal corporation in Hall County, Nebraska, as Grantor, in consideration for such <br />conveyance, the Grantee will convey a similar tract of land to the Grantor as an even exchange <br />with no net consideration paid by either party to the other, hereby grants, bargains, sells, <br />conveys, and confirms unto <br />ROBERT M. ALLEN FAMILY LIMITED PARTNERSHIP <br />
