<br />Affiant, MARY JANE MURPHY HARDER, after being first duly sworn
<br />on oath, deposes and states as follows:
<br />0
<br />1. That Affiant is the surviving spouse of RAYMOND J. HARDER,
<br />who died April 22, 2002, as shown by the certified copy of the
<br />Decedent's death certificate attached hereto as Exhibit "A" and by
<br />this reference incorporated herein; that Exhibit "A" is a certified
<br />copy of the original Certificate of Death on file with the Bureau
<br />of Vital Statistics, Department of Health, State of Nebraska.
<br />2. That Affiant and the said Decedent were husband and wife
<br />on the date of the Decedent's death on April 22, 2002, and were on
<br />said date the sole owners as joint tenants not tenants in common,
<br />of the real estate located at 1308 West John St., Grand Island,
<br />Nebraska 68801, and legally described as follows:
<br />Part of Fractional Block Three (3) in Windolph's Addition, and
<br />Part of Fractional Block Thirty -Eight (38) in Charles Wasmer's
<br />Addition, both being Additions to the City of Grand Island,
<br />Hall County, Nebraska, more particularly described as follows,
<br />viz: Commencing at the Southeasterly corner of Fractional Lot
<br />Three (3) in Fractional Block Three (3) in Windolph's Addition
<br />to the City of Grand Island, Nebraska, running thence in a
<br />Northwesterly direction along and upon the Easterly boundary
<br />line of said Fractional Lot 3, being also the Westerly
<br />boundary line of Adams Street, for a distance of 132 feet,
<br />running thence in a Westerly direction, parallel with the
<br />Northerly boundary line of John Street, in the City of Grand
<br />Island, Nebraska, for a distance of 106 feet, running thence
<br />in a Southerly direction, parallel with the Westerly boundary
<br />line of Adams Street, for a distance of 132 feet, to the
<br />Northerly boundary line of John Street, running thence in an
<br />Easterly direction, along and upon the Northerly boundary line
<br />of John Street, for a distance of 106 feet to the place of
<br />beginning, being a rectangular tract of ground having a
<br />Southerly frontage of 106 feet on John Street, and a depth of
<br />132 feet, and bounded on the Easterly side thereof by Adams
<br />Street, in the City of Grand Island, Nebraska; excepting
<br />therefrom a tract of land conveyed by Warranty Deed recorded
<br />in the office of the Register of Deeds of Hall County,
<br />Nebraska on September 29, 1992, as Document No. 92- 108402 and
<br />legally described as follows:
<br />Part of Fractional Block Three (3), Windolph's Addition
<br />and Complement, Fractional Block Thirty -Eight (38), Charles
<br />Wasn -Ler's Addition, both being Additions to the City of Grand
<br />Island, Hall County, Nebraska, and more particularly described
<br />as follows: Beginning at the Southeasterly corner of
<br />Fractional Lot Three (3), Fractional Block Three (3),
<br />Windolph's Addition to the City of Grand Island, Hall County,
<br />Nebraska, thence Westerly on the Northerly line of John Street
<br />a distance of 54 feet; thence Northerly parallel with the
<br />Westerly line of Adams Street a distance of 132 feet; thence
<br />Easterly parallel with the Northerly line of John Street a
<br />distance of 54 feet to the Westerly line of Adams Street;
<br />thence Southerly on the Westerly line of Adams Street a
<br />distance of 132 feet to the point of beginning.
