Return to (closer DS ) <br />AMERICAN TITLE COMPANY <br />6029 Beltline Read, Suite 250 <br />Dallas, TX 75254 <br />SPACE ABOVE THIS LINE FOR RECORDER'S USE <br />[SPTIHS, NE] <br />TERMINATION OF LEASES <br />THIS TERMINATION OF LEASES, dated as of this 31 day of <br />December, 2001, by and between SPTIHS PROPERTIES TRUST, a <br />Maryland real estate investment trust( "Landlord "), and FIVE STAR <br />QUALITY CARE -NE, LLC, a Delaware limited liability company <br />formerly known as SHOPCO -NE, LLC ( "Tenant "). <br />W I T N E S S E T H: <br />WHEREAS, pursuant to the terms of certain lease, as amended <br />and assigned to Landlord and Tenant, dated April 1, 1995 (the <br />"Lease ") which incorporated by reference the terms of an <br />Amended, Restated and Consolidated Master Lease Document, <br />dated as of September 24, 1997, as amended, between the Landlord <br />and Tenant ( "Master Lease "), memorandum of which Lease was <br />recorded as set forth on Schedule A attached hereto, Landlord <br />leased to Tenant and Tenant leased from Landlord certain <br />premises, as more particularly described on Exhibit A attached <br />to each respective Lease (the "Premises "); <br />WHEREAS, Landlord and Tenant now wish to terminate the <br />Master Lease and the Lease; <br />NOW, THEREFORE, in consideration of the mutual covenants <br />herein contained and other good and valuable consideration, the <br />mutual receipt and legal sufficiency of which are hereby <br />acknowledged, Landlord and Tenant hereby agree as follows: <br />1.
