DAVIS, <br />A SINGLE PERSON hereinafter referred to as "Borrower ". <br />WITNESSETH: <br />WHEREAS, borrower has previously executed and delivered unto Lender a certain Note <br />secured by a Deed of Trust /Mortgage upon that real estate described as: <br />THE SOUTH EIGHTY NINE AND ONE HALF FEET (89 1/2') OF LOT TEN (10), BLOCK <br />SEVENTY THREE (73), WHEELER AND BENNETT'S ADDITION TO THE CITY OF <br />GRAND ISLAND, HALL COUNTY, NEBRASKA. <br />which Deed of Trust /Mortgage was dated JULY 8, 1998 and filed for record on JULY 17, 1998, as <br />INSTRUMENT NO. 98- 106982 in the OFFICE OF THE HALL COUNTY REGISTER OF DEEDS, <br />HALL COUNTY, STATE OF NEBRASKA. <br />WHEREAS, such Deed of Trust/Mortgage had a stated maturity date of AUGUST 1, 2008; <br />WHEREAS, Lender and Borrower have mutually agreed to renew and extend the <br />indebtedness secured by such Deed of Trust/Mortgage, <br />WHEREAS, such Deed of Trust does not contain a provision regarding a right to future <br />advances to be secured by such Deed of Trust; <br />WHEREAS, Borrower has requested that Lender make an additional advance to be secured by <br />such existing Deed of Trust; <br />WHEREAS, Lender is willing to make an additional advance to be secured by such Deed of <br />Trust; <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />identified hereinabove to provide that it shall continue to secure the presently remaining indebtedness <br />and the additional advance and future advances from and after the date hereinafter specified; <br />NOW, THEREFORE, in consideration of such renewal and extension, the parties hereto give <br />notice in accord with NEB. REV. STAT. SS 76 -239 of the continued effectiveness of the Deed of <br />Trust/Mortgage above described in the following respects: <br />1. MATURITY DATE. The stated maturity of the above - described Deed of Trust /Mortgage <br />is hereby AMENDED TO MAY 1, 2017. <br />2. INCORPORATION OF FUTURE ADVANCE RIGHTS. From and after the date of the <br />execution of this Deed of Trust Modification Agreement, the indebtedness secured by the Deed of <br />Trust described hereinabove shall secure advances made concurrently herewith and future advances in <br />
