ROBERTS, a single person, hereinafter referred to as "Su ordinating Party" <br />(whether one or more), for the benefit of CENTRAL PLATTE NATURAL RESOURCES <br />DISTRICT, a Nebraska political subdivision, hereinafter referred to as "Easement Holder ". <br />WITNESSETH: <br />WHEREAS, Subordinating Party, has been granted a permanent and perpetual right -of- <br />way and easement to construct, operate and maintain, a driveway for ingress and egress purposes <br />upon, over and across that real estate described as: <br />A tract of land comprising a part of the East Half of the Southeast Quarter <br />(E 1 /2SEI /4) and a part of the East Half of the Northeast Quarter (E 1 /2N E 1 /4), all <br />in Section One (1), Township (10) North, Range Ten (10) West of the 6h P.M., in <br />Hall County, Nebraska, more particularly described as: <br />Beginning at the Southeast corner of said East Half of the Northeast Quarter <br />(El /2NEI /4); thence running westerly along the southerly line of said East Half of <br />the Northeast Quarter (El /2NEI /4), on an assumed bearing of S 86 °37'08" E, a <br />distance of Two Hundred Seventeen and One Tenth (217.10) feet, to a point on <br />the westerly right of way line of U.S. Highway No. 281 and the actual point of <br />beginning; thence running N 00 °00'00" W along the westerly right of way line of <br />Highway No. 281 and its extension, a distance of One Thousand Two Hundred <br />Six and Ninety -Six Hundredths (1,206.96) feet; thence running S 86 °17'46" W a <br />distance of Forty -Five and Nine Hundredths (45.09) feet; thence running S <br />00 °00'00" E, a distance of One Thousand Two Hundred Six and Seventy -One <br />Hundredths (1206.71) feet, to a point on the south line of said East Half of the <br />Northeast Quarter (E1 /2NEI /4), and the north line of said East Half of the <br />Southeast Quarter (E1 /2SE1 /4); thence running S 00 °00'20" E, a distance of <br />Thirty (30.0) feet; thence running N 86 °37'08" E, a distance of Forty -Five and <br />Eight Hundredths (45.08) feet, to a point on the westerly right of way line of <br />Highway No. 281; thence running N 00 °00'20" W, along the westerly right of <br />way line of Highway No. 281, a distance of Thirty (30.0) feet, to the actual point <br />of beginning and containing 1.278 acres more or less, <br />hereinafter referred to as the "Subordinated Easement ". <br />WHEREAS, the Easement Holder has previously acquired a Temporary Construction <br />Easement, Flowage Easement and Flood Protection Levee Easement from Subordinating Party in <br />respect to a tract owned by Subordinating Party whereby certain funds have been paid to the <br />Subordinating Party for unrestricted rights of use for public purposes in respect to real estate <br />which includes in part or in whole the Subordinated Easement; <br />c`rt® <br />Q <br />CAV <br />fC <br />co <br />0 <br />C <br />n <br />N <br />O - <br />O <br />c a <br />N <br />0 <br />p <br />C, <br />p <br />c~n <br />T Z <br />N <br />Ri <br />i'a � <br />-T7 <br />a ra <br />p <br />m <br />° <br />r <br />r n <br />ut <br />C.� <br />N <br />(O <br />(n <br />THIS AGREEMENT made and executed this day of 2002, by <br />MARJORIE A.
