Hult and Caroline J. <br />Hult, usband and wife, "Grantors," and Ronald F. Knodel and <br />Lynelle S. Knodel, husband and wife, "Grantees." <br />RECITALS: <br />WHEREAS, Grantors own the real estate legally described on <br />Exhibit A (illustrated by Exhibits B and C) attached hereto and <br />made a part hereof by reference, hereafter referred to as "the <br />Servient Estate "; and <br />WHEREAS, Grantees are the owners of the real estate legally <br />described on Exhibit D attached hereto and made a part hereof by <br />reference, hereafter referred to as "the Dominant Estate "; and <br />WHEREAS, the parties wish to enter into this Easement <br />Agreement. ' <br />IN CONSIDERATION of the mutual covenants and agreements of the <br />parties, it is therefore agreed as follows: <br />1. Grantors hereby grant and convey to Grantees an easement <br />upon the Servient Estate for the purpose of maintaining, repairing <br />and servicing the leech field which is currently used for disposal <br />of sewage from the residence located on the Dominant Estate. <br />2. The leech field shall be repaired, maintained and <br />serviced by Grantees at Grantees' sole expense. Grantees have the <br />right to make such repairs, service and maintenance as Grantees in <br />their sole discretion deem necessary for the purposes stated <br />herein. <br />3. Grantors covenant and agree that they will not construct <br />or install any permanent improvements or plant or permit the growth <br />of trees upon the Servient Estate and will not obstruct or restrict <br />Grantees' access to the Servient Estate for the purposes stated <br />herein. <br />4. This easement shall run with the land and shall be <br />binding and inure to the benefit and detriment to the parties to <br />this agreement, their respective heirs, successors and assigns <br />except that in the event the leech field should ever deteriorate to <br />the extent that it is necessary to reconstruct the leech field, it <br />shall be relocated upon the Dominant Estate.
