Hult and Caroline J. Hult, usband and wife, "Grantors," and Ronald F. Knodel and Lynelle S. Knodel, husband and wife, "Grantees." RECITALS: WHEREAS, Grantors own the real estate legally described on Exhibit A (illustrated by Exhibits B and C) attached hereto and made a part hereof by reference, hereafter referred to as "the Servient Estate "; and WHEREAS, Grantees are the owners of the real estate legally described on Exhibit D attached hereto and made a part hereof by reference, hereafter referred to as "the Dominant Estate "; and WHEREAS, the parties wish to enter into this Easement Agreement. ' IN CONSIDERATION of the mutual covenants and agreements of the parties, it is therefore agreed as follows: 1. Grantors hereby grant and convey to Grantees an easement upon the Servient Estate for the purpose of maintaining, repairing and servicing the leech field which is currently used for disposal of sewage from the residence located on the Dominant Estate. 2. The leech field shall be repaired, maintained and serviced by Grantees at Grantees' sole expense. Grantees have the right to make such repairs, service and maintenance as Grantees in their sole discretion deem necessary for the purposes stated herein. 3. Grantors covenant and agree that they will not construct or install any permanent improvements or plant or permit the growth of trees upon the Servient Estate and will not obstruct or restrict Grantees' access to the Servient Estate for the purposes stated herein. 4. This easement shall run with the land and shall be binding and inure to the benefit and detriment to the parties to this agreement, their respective heirs, successors and assigns except that in the event the leech field should ever deteriorate to the extent that it is necessary to reconstruct the leech field, it shall be relocated upon the Dominant Estate. The construction of a new leech field upon the Dominant Estate shall cause the immediate termination of this Easement Agreement without further notice.
