AITKEN, hereinafter referred to as the "Affiant ", being first duly <br />sworn, upon oath deposes and states: <br />1. Affiant is a registered land surveyor employed by Olsson Associates. <br />2. Olsson Associates was retained by Central Platte Natural Resources District <br />for the purpose of preparing legal descriptions in connection with land acquisitions it <br />intended to make for the Wood River Diversion Project. <br />3. Affiant has examined the Surveyor's Certificate to the recorded plat of Pierce <br />Subdivision, Hall County, Nebraska filed of record on August 13, 1992 as Document No. <br />92- 107072. <br />4. On February 25, 2002 Affiant is aware that a Flood Protection Levee Easement <br />and a Right of Way Contract filed in the Office of the Register of Deeds of Hall County, <br />Nebraska, as Instrument Nos. 200202109 and 200202111, contained the following legal <br />description: <br />TRACT 702E -2 <br />A Permanent Easement located in Section Thirty -Four (34), Township <br />Eleven (11) North, Range Ten (10) West, of the 6th P.M., Hall County, <br />Nebraska, and more particularly described as follows: <br />Commencing at the Southeast Corner of the Southeast Quarter, (SE <br />Corner SE1 /4) of said Section Thirty -Four (34), said point also being the <br />point of beginning; thence on assumed bearing of S 89 °09'47" W along <br />the South line of said SE 1 /4 a distance of 380.00 feet; thence N 03'26'52" <br />W along the West line of Lot 1, Pierce Subdivision a distance of 4.00 feet; <br />thence N 89 °09'47" E and parallel to the South Line of said SE1 /4 a <br />distance of 380.19 feet to a point on the East line of Said SE1 /4; thence S <br />00'50'13" E along said East line a distance of 4.00 feet to the point of <br />S <br />
