Such flowage easement shall further provide that no structures <br />for human habitation shall be constructed or maintained on the land except <br />as may be approved in writing by a representative of the Condemner. <br />Notwithstanding such flowage easement, fee title owners to the parcel <br />subject to the flowage easement hereafter described shall retain a right to <br />use such parcel in any manner as it may be used and enjoyed without <br />interfering with the use to be made by the Condemner or otherwise <br />abridging the rights attendant to the flowage easement to be acquired and <br />subject to the requirement that any use of the land shall be subject to <br />Federal and State law with respect to pollution with the continued right of <br />excavation for the purposes of quarrying sand, gravel, etc. being <br />permitted, subject only to approval by Condemner as to the placement of <br />the overburden, if any, in connection with such excavation.
