Such flowage easement shall further provide that no structures for human habitation shall be constructed or maintained on the land except as may be approved in writing by a representative of the Condemner. Notwithstanding such flowage easement, fee title owners to the parcel subject to the flowage easement hereafter described shall retain a right to use such parcel in any manner as it may be used and enjoyed without interfering with the use to be made by the Condemner or otherwise abridging the rights attendant to the flowage easement to be acquired and subject to the requirement that any use of the land shall be subject to Federal and State law with respect to pollution with the continued right of excavation for the purposes of quarrying sand, gravel, etc. being permitted, subject only to approval by Condemner as to the placement of the overburden, if any, in connection with such excavation.
