<br />heirs, successors and assigns, an easement for ingress and egress over, through and upon that real
<br />estate described as:
<br />Commencing at the Northeast corner of the Southeast Quarter (NE Cor. SE1 /4) of
<br />Section Thirty -Four (34), Township Eleven (11) North, Range Nine (9) West of
<br />the 6a' P.M., Hall County, Nebraska; thence on an assumed bearing of S
<br />01'50'26" E along the East line of said SETA a distance of 848.39 feet, said point
<br />also being the point of beginning; thence continuing south on an assumed bearing
<br />of S 01 °50'26" E a distance of 50.00 feet; thence S 88 °09'59" W a distance of
<br />44.00 feet; thence N 05'49'13" W a distance of 50.00 feet; thence N 88'01'1 YE
<br />a distance of 47.47 feet to the point of beginning.
<br />2. Rights of Easement. Grantors further grant and convey unto Grantees, their heirs,
<br />successors and assigns, full and free right and liberty for Grantees, their tenants, servants, visi-
<br />tors, and licensees, in common with all others having the like right, at all times hereafter, with or
<br />without vehicles of any description, for all purposes connected with the use and enjoyment of the
<br />said land of the Grantees for whatever purpose the said land may be from time to time lawfully
<br />used and enjoyed, to pass and re -pass along the said private drive so established for the purpose
<br />of access to the Grantees' property.
<br />3. Grantors' Retention of Rights. Such easement hereby established is specifically
<br />subject to the reservation by the Grantors that the same may be used by the Grantees, their heirs,
<br />successors and assigns, in conjunction with the use of the Grantors, their heirs, successors and
<br />assigns, as to its entirety, and further subject to the express understanding that the Grantors, their
<br />heirs, successors and assigns, shall in no way be bound to construct or maintain the private drive
<br />and shall in no way assume any liability or responsibility to Grantees, their heirs, successors and
<br />assigns, or any other person using said private drive by invitation, express or implied, or by rea-
<br />son of any business conducted with the Grantees, their heirs, successors or assigns, or otherwise.
<br />4. Indemnification. Grantees, their heirs, successors and assigns, shall indemnify and
<br />hold Grantors, their heirs, successors and assigns, harmless from any liability in respect to the
<br />injury of any person while using such easement with the permission or at the direction of the
<br />Grantees, their heirs, successors and assigns.
<br />5. Binding Effect. This Access Easement Agreement shall be binding upon, and shall
<br />inure to the benefit of, the parties hereto, their heirs, legal representatives, successors and
<br />assigns.
<br />IN WITNESS WHEREOF, the undersigned have executed this Access Easement
<br />Agreement on the date first noted above.
