<br />TMS MORTGAGE, INC., GRANTOR, in consideration of
<br />AND OTHER VALUABLE CONSIDERATION

<br />WENDELL L. FAIRBANKS and SARAH S. FAIRBANKS,

<br />conveys to GRANTEE, as joint tenants and not as tenants in common, the following
<br />described real estate (as defined in Neb. Rev. Stat. 76 -201):
<br />Lot One Hundred Thirty One (131), in Buenavista Subdivision,
<br />an Addition to the City of Grand Island, Hall County, Nebraska.
<br />GRANTOR covenants (jointly and severally, if more than one) with GRANTEE that
<br />GRANTOR:
<br />(1) It is seized and possessed of the said land and has a right to convey it, and warrants
<br />the title against the lawful claims of all persons claiming by, through and under it, but
<br />not further otherwise; and
<br />(2) That the real estate is free from encumbrances, except easements, restrictions,
<br />reservations, and covenants of record; and
<br />(3) By accepting this Special Warranty Deed, Grantee acknowledges that he has had
<br />adequate opportunity to inspect the property conveyed herein as well as all
<br />improvements located thereon. Except as specifically set forth in this Special
<br />Warranty Deed this conveyance is made without warranty or representation, either
<br />expressed or implied and is on an "AS IS" and "WHERE IS" basis.
