<br />This Trust Deed, made this 26th day of March, 2002, between Big B, Inc., a Nebraska Corporation;
<br />whose address is 4444 West 13`' Street, Grand Island, NE 68803, Trustor, and Bruce I. Smith,
<br />Attorney at Law, whose address is P. O. Box 790, Grand Island, NE 68802, Trustee,
<br />Witnesseth: That Whereas, Trustor has executed one certain Deed of Trust Note dated November
<br />1, 2000, and drawn to the order of Metropolitan Life Insurance Company, hereinafter called
<br />Beneficiary, for the principal sum of —FOUR MILLION ONE HUNDRED FIFTY THOUSAND -
<br />Dollars ($4,150,000.00), payable in lawful money of the United States which shall be legal tender
<br />in payment of all debts and dues, public and private, at the time of payment, payable in installments,
<br />the final installment due November 15, 2020, with interest thereon from the date thereof as therein
<br />provided.
<br />And Whereas, Trustor is desirous of securing the prompt payment of said Deed of Trust Note and
<br />all interest and charges thereon, in whose hands soever the same may be.
<br />Now, therefore, Trustor, in consideration of the premises, and for the purpose aforesaid, hath
<br />granted, bargained, sold, and conveyed, and hereby does grant, bargain, sell and convey unto the
<br />Trustee, in trust, with power of sale, pursuant to the Nebraska Trust Deeds Act (Section 76 -1001 et.
<br />seq.), all the following described real estate, premises and property, situate in the County of Hall and
<br />State of Nebraska, to wit:
<br />PARCEL 1: A tract of land comprising all of the Northwest Quarter (!4WI /4) and part of the Northeast
<br />Quarter (NEI/4) of Section Six (6), Township Eleven (11) North, Rouge Tea (10) West of the 6th P.M.,
<br />Hall County, Nebraska, and more particularly described as follows:
<br />Beginning at the northwest corner of said Northwest Quarter (NWI /4)1 thence running easterly, along
<br />and upon the north tine of said Northwest Quarter (NWl /4), a distance of Two Thousand Five Hundred
<br />Fifteen and Seventy Seven Hundredths (2,515.77) feet to the northwest corner of said Northeast Quarter
<br />(NET /4); thence deflecting left Olt° 09' 07' and running easterly along and upon the north lint of said
<br />Northeast Quarter (NE1 /4), a distance of Five Hundred Fitly Six and Sixty Eight Hundredths (556.68)
<br />feet; thence deflecting right 80° 04' 02" and running southeasterly, a distance of Two Thousand Three
<br />Hundred Seventy and Eight Hundredths (2,370.08) feet; thence deflecting right 01' 57' 50" and running
<br />southeasterly, a distance of Three Hundred Thirteen and Fifty One Hundredths (313-51) feet to a point
<br />on the south line of said Northeast Quarter (NEl /4); thence deflecting right 97' 58' 46' and running
<br />westerly, along and upon the south line of said Northeast Quarter (NET /4) and along and upon the
<br />south line of said Northwest Quarter (NWT /4), a distance of Three Thnusand Five Hundred Twenty
<br />Four and Six Hundredths (3,524.06) feet to the southwest corner of said Northwest Quarter (NWl /4);
<br />thence deflecting right 89' 58' 29' and running northerly, along and upon the nest line of said Northwest
<br />Quarter (NWT /4), a distance of Two Thousand Six Hundred Fifty One and Six Hundredths (2,651.06)
<br />feet to the point of beginning.
