200203181 <br />ADDENDUM <br />TO <br />FLOOD PROTECTION LEVEE EASEMENT - CORPORATION (page 1) <br />PROJECT: 97- 0174.04 TRACT: 603 <br />KNOW ALL MEN BY THESE PRESENTS: <br />Central Platte Natural Resources District which is the <br />Grantee in the Flood Protection Levee Easement granted by J. I. <br />L. Asphalt Paving Co. concerning Tract 603 of Project No. 97- <br />0174.04 (the easement) for and in consideration of Grantor's <br />granting the easement does hereby accept the provisions contained <br />in the easement document and does further promise, covenant and <br />agree as follows: <br />1. Grantee shall maintain the box culvert described in the <br />easement document to which this is an addendum at all times free <br />and clear of any obstructions to the free flow of surface water <br />to and through it. <br />2. At all times Grantee shall construct and maintain the <br />fish gates described in the easement document to which this is an <br />addendum to prevent fish from passing through the box culvert and <br />to prevent debris from blocking the box culvert to the <br />satisfaction of Grantor. <br />3. If and when Grantor, at its expense, constructs a new <br />levee (the new levee) on its real estate which is north of the <br />real estate described in the easement and which will permanently <br />serve the same function as the initial levee (the initial levee) <br />which Grantor will construct on the real estate described in the <br />Easement, then Grantee will, at its expense, construct two (2) <br />new levees (the connecting levees) running northerly and <br />southerly, one to run from the initial levee at the western <br />boundary of Grantor's real estate and the other to run from the <br />initial levee at the eastern boundary of Grantor's real estate, <br />which will respectively connect with the western end and the <br />
