200203093 Lands and Funds is the only entity entitled to compensation for said taking, or any portion thereof. 7. That the State of Nebraska, acting by and through the Board of Educational Lands and Funds has not withdrawn the aforesaid sum, or any portion thereof, from the registry of the court and is entitled to have the full compensation disbursed to it. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED: 1. That the stipulation between the parties filed March 7, 2002, is hereby approved. 2. That title to the estate concerned in the proceeding as set forth in the Complaint in Condemnation and Declaration of Taking, and also as set forth in paragraph 6 above, is vested to the United States upon the date of the filing of the Declaration of Taking and deposit of the estimated just compensation; and that the estate condemned is taken for the public use of the United States as authorized by law, and title to said property is vested in the United States of America, free and clear of any liens or claims whatsoever, subject to the existing public road right -of -way and the existing electric line power right -of -way, as set forth in paragraph 6 above. 3. That the sum of $127,000.00 is full compensation for the taking of said estate; which amount shall be subject to all liens, encumbrances and charges of whatsoever nature, including claims of other parties to ownership, liens encumbrances or charges, against the land at the time of vesting of title thereto in the United States of America and that all such liens, encumbrances and charges of whatsoever nature shall be payable and deductible from the said sum, including any claims whatsoever nature against the United States of America by reason of the institution and prosecution of this action. rd
