<br />TRUSTEE'S DEED
<br />KNOW ALL MEN BY THESE PRESENT: That TIERONE BANK, a United States
<br />Corporation, formerly known as First Federal Lincoln Bank, formerly known as First
<br />Federal Savings and Loan Association of Lincoln, Trustee, upon a Deed of Trust made and
<br />entered into on or about August 18, 1995, by and between DONALD W. MOBERG AND
<br />SANDY M. MOBERG, husband and wife, Trustors, and TIERONE BANK, a United States
<br />Corporation, formerly known as First Federal Lincoln Bank, formerly known as First
<br />Federal Savings and Loan Associaiton of Lincoln, Beneficiary- Lender and recorded August
<br />21, 1995 as Document No. 95- 105611 in the office of the Register of Deeds of Hall County,
<br />Nebraska, herein called the GRANTOR, in consideration ofForty -six Thousand and No/ 100
<br />Dollars ($46,000.00), received from Grantee, does hereby grant, bargain, sell, convey and
<br />confirm unto TIERONE BANK, a United States Corporation, herein called the GRANTEE,
<br />the following described real estate in Hall County, Nebraska:
<br />Lot Twelve (12), Argo Second Subdivision to Alda, Hall County, Nebraska, more
<br />commonly known as 115 Jupiter Street, Alda, Nebraska 68810
<br />TO HAVE AND TO HOLD the above - described premises together with all
<br />tenements, hereditaments and appurtenances thereto belonging unto the Grantee, and to
<br />Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with the Grantee andwiththe Grantee's successors and
<br />assign:
<br />(1) That Donald W. Moberg and Sandy M. Moberg, Trustors, failed to pay the
<br />Beneficiary payments which were contractually due, and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest
<br />thereon, at once immediately due and payable,
<br />(2) That a Notice of Default and Election to Sell was filed by Grantor December
<br />6, 2001 as Instrument No. 0200112535 in the Records of the Register of Deeds of Hall
<br />County, Nebraska. A copy of the Notice of Default and Election to Sell was served upon
<br />Donald W. Moberg; Sandy M. Moberg, and Internal Revenue Service, by U.S. mail,
<br />certified, return receipt requested, and also upon Donald W. Moberg and Sandy M. Moberg
<br />by first class mail, postage prepaid, on December 13, 2001.
<br />(3) That Trustors, Donald W. Moberg and Sandy M. Moberg, failed to cure the
<br />default referenced in the Notice of Default and Election to Sell within 30 days after the
<br />service of the Notice of Default and Election to Sell.
<br />(4) That a Notice of Trustee's Sale was published and a copy of the Notice of
<br />Trustee's Sale was served upon Donald W. Moberg, and Sandy M. Moberg, by U.S. mail,
<br />certified, return receipt requested, and by first class mail, postage prepaid, on January 25,
<br />2002 and upon Internal Revenue Service, by U.S. mail, certified, return receipt requested
<br />postage prepaid, on January 28, 2002.
