200203027 ASSIGNMENT OF REAL ESTATE CONTRACT- -Page Two 5. In the event of a default by the Assignor in the performance of its obligations pursuant to any agreement secured hereby, or in the performance of any obligation in this assignment, the Bank shall be entitled, at its sole option and without notice, to declare all sums secured by this assignment to be immediately due and payable and may commence foreclosure of this assignment by judicial proceedings and to enter upon and take possession of the premises, to collect and receive the rents and apply the same, less costs of operation and collection, upon the indebtedness owned by the Assignor to the Bank, said rents and profits being hereby assigned to the Bank as further security for per- formance of all obligations secured hereby. Provided further that if the Assignor shall pay to City National Bank and Trust Company, Hastings, Nebraska, all of the sums of money borrowed from them in full, together with any sums which may or might have become due hereunder, the Assignor shall be entitled to a written release from the Bank of this assignment, however, until such time, this assignment shall remain in full force and effect as security for any debt owed by the Assignor to the Bank.
