Mettenbrink, being <br />first duly <br />sworn, deposes <br />and <br />states those facts <br />of <br />which he <br />has personal <br />knowledge as <br />set <br />forth hereinbelow: <br />1. That pursuant to paragraph 18. of that certain Agree- <br />ment for Sale and Purchase of Real Estate dated January 6, 1995 <br />Robert G. Wenzl and Reburta R. Wenzl, husband and wife, as Sell- <br />ers granted to Affiant and Affiant's wife, Roxanne Mettenbrink, <br />an option to purchase all of Sellers' interest in the following <br />described real estate, to -wit: <br />Lot One (1) Wenzl Second Subdivision, <br />Hall County, Nebraska. <br />2. That said option period granted to Affiant was for a <br />period of sixty (60) months commencing on July 28, 1995 and end- <br />ing on June 28, 2000. <br />3. That Affiant and Affiant's wife, <br />failed to exercise said option to purchase <br />est in Lot One (1) Wenzl Second Subdivisio <br />Nebraska during the option period and that <br />terminated by its terms and is, therefore, <br />effect whatsoever. <br />Affiant further saith not. <br />Roxanne Mettenbrink, <br />all of Sellers' inter- <br />n, Hall County, <br />this option thereafter <br />of no further force or <br />Gary R.
