<br />LICENSE AGREEMENT
<br />This License Agreement is made by and between the CITY OF GRAND ISLAND,
<br />NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and ST. MARY'S
<br />CHURCH, a corporation (Grand Island, Nebraska), hereinafter referred to as the "Licensee."
<br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set
<br />forth the terms and conditions under which the Licensee may construct, maintain, repair, and
<br />utilize the following described improvement which will infringe upon an easement held by the
<br />Licensor:
<br />Installation, maintenance and repair of concrete sidewalk across the sixteen (16.0)
<br />foot wide easement between First Street and Division Street, from Cedar Street to
<br />Elm Street as shown on the attached site plan AND
<br />Installation, maintenance and repair of a hard surfaced parking lot for the Parish
<br />Center in the easement (vacated Division Street) from Elm Street to Cedar Street.
<br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the
<br />following described real estate adjacent to the Licensor's easement to which this License
<br />Agreement shall apply:
<br />Block One Hundred (100), Lots One (1), Two (2), Three (3), Four (4), Five (5),
<br />Six (6), Seven (7), and Eight (8) of Railroad m the city of Grand
<br />Island, Hall County, Nebraska td'L
<br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the
<br />Licensee may construct, maintain, repair and utilize the above described improvement at the
<br />Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its
