200202629 <br />said debt. Bank and Vanosdall agree that the terms of this loan shall be as follows: 71/2% <br />interest per annum on the principal amount with monthly payments based on a 15 year <br />amortization with a balloon payment after 3 years. In the event Vanosdall is unable or unwilling <br />to make said payments and said payments become 30 days delinquent Bank will have the option <br />to foreclose its Deed of Trust on said property, sell the property and apply all proceed therefrom <br />to the total indebtedness. <br />6. Upon satisfactory completion of the above requirements by ECI and /or Vanosdall, and <br />after all proceeds received in completion of the requirements have been credited to the <br />indebtedness, if a balance remains on the above indebtedness, Bank agrees to further credit <br />towards said indebtedness an amount not exceeding $100,000 in payment of the indebtedness <br />prior to beginning collection against the personal assets of Vanosdall. <br />7. This agreement assumes that there has been full disclosure of all information regarding <br />the financial affairs of ECI and Vanosdall.
