Siemers and Betty Joan Siemers, husband and wife, hereinafter jointly and severally referred to as a "Grantors ", prior to executing the attached Deed of Trust dated Ckt o loea I , 2001, by and between Grantors and Nebraska Law Offices P.C., a Nebraska professional corporation ( "Beneficiary") (the "Deed of Trust "), hereby states and acknowledges as follows: 1. Grantors represents and warrants to Beneficiary that Grantors' dwelling house and other buildings subject to a homestead are presently located upon one or more of the real estate parcels legally described on Exhibit A attached hereto and incorporated herein (the "Property"). 2. Grantors acknowledges that Grantors have a right to make a designation of homestead in the Deed of Trust for the purpose of affording the opportunity to retain Grantors' homestead in the event of default and trustee's sale under the Deed of Trust. 3. Grantors acknowledge that the execution of this Waiver constitutes the complete waiver of rights otherwise available for the purpose of affording the opportunity to retain a homestead in the event of a default and any trustee's sale under the Deed of Trust. 4. Grantors state that this acknowledgment and waiver is Grantors' knowing and voluntary act and deed, and Grantors do hereby willingly and voluntarily waive, relinquish and remise any and all right to make a designation of homestead in the Deed of Trust. 5. Grantors further understand and agree that this acknowledgment and waiver shall be filed as a Preface to and become a part of the Deed of Trust.
