Siemers and Betty Joan Siemers, husband and wife, hereinafter jointly and severally referred to as a <br />"Grantors ", prior to executing the attached Deed of Trust dated Ckt o loea I , 2001, by <br />and between Grantors and Nebraska Law Offices P.C., a Nebraska professional corporation ( "Beneficiary") <br />(the "Deed of Trust "), hereby states and acknowledges as follows: <br />1. Grantors represents and warrants to Beneficiary that Grantors' dwelling house and <br />other buildings subject to a homestead are presently located upon one or more of the real estate parcels legally <br />described on Exhibit A attached hereto and incorporated herein (the "Property"). <br />2. Grantors acknowledges that Grantors have a right to make a designation of homestead <br />in the Deed of Trust for the purpose of affording the opportunity to retain Grantors' homestead in the event <br />of default and trustee's sale under the Deed of Trust. <br />3. Grantors acknowledge that the execution of this Waiver constitutes the complete <br />waiver of rights otherwise available for the purpose of affording the opportunity to retain a homestead in the <br />event of a default and any trustee's sale under the Deed of Trust. <br />4. Grantors state that this acknowledgment and waiver is Grantors' knowing and <br />voluntary act and deed, and Grantors do hereby willingly and voluntarily waive, relinquish and remise any and <br />all right to make a designation of homestead in the Deed of Trust. <br />5.
