<br />That a Deed of Imsi was made and cntared into on or about October 14, 1998, by and between

<br />Claude Rinke, a single person, as Truster, and One Stop Mortgage, Inc., Beneficiary, wherein Walter L.
<br />Griffiths was named Trustee. This Deed of Trust was recorded October 22, 1998 in the Records of the
<br />Register of Deeds of Hall County, Nebraska as Instrument No. 98- 110359.
<br />On or about October 21, 1998, One Stop Mortgage, Inc., Beneficiary, assigned all of its right,
<br />title and heneficial interest in the Deed of Trust to Armes Capital Corporation. The Assignment was
<br />recorded July 9, 1999, in the office of the Register of Deeds of Hall County, Nebraska, as Instrument
<br />No. 99- 106909.
<br />On or about October 21, 1999, Aames Capital Corporation, Beneficiary, assigned all of its right,
<br />title and beneficial interest in the Deed of Trust to Bank One, National Association, as Trustee. The
<br />Assignment was recorded September 5, 2000, in the office of the Register of Deeds of Hall County,
<br />Nebraska, as Instrument No. 200007234.
<br />Christopher S. Wallace, Attorney at Law, has been appointed Successor Trustee, pursuant to a
<br />Substitution of 'Trustee filed for record with the Register of Deeds of Hall County, Nebraska.
<br />Hereinafter the Success., 'trustee, Christopher S. Wallace, Attorney at Law, will be referred to as
<br />GRANTOR.
<br />The GRANTOR in consideration of Fifty -Three Thousand Five Hundred Fifty Dollars and
<br />No Cents ($53,550.00) and other valuable consideration received from Bank One, National
<br />Association, as Trustee, hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm
<br />unto GRANTEE, the following described real property in Hall County, Nebraska:
<br />The South 140.2 feet of Lot 11, Geer Subdivision of Lots 6, 7 and 8 of Garrets
<br />Subdivision in the City of Grand Island, Hall County, Nebraska, EXCEPT the
<br />Southerly 25.0 feet thereof.
<br />To have and to hold the above - described premises together with al I tenements, hereditaments and
<br />appurtenances thereto belonging unto the GRANTEE, and to the GRANTER'S successors and assigns
<br />forever.
<br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors
<br />and assigns:
<br />(1) That Claude Rinke, a single person, as Truster, failed to pay the Beneficiary payments
<br />which were contractually due, and the GRANTOR, at the request of the Beneficiary, elected to declare
<br />the catiiru unpaid pi ucipai batanc , together with interest thereon, at once immediately due and payable.
<br />(2) That a Notice of Default was recorded by GRANTOR on June 11, 2001, as Instrument
<br />No. 0200105579, in the records of the Register of Deeds, Hall County, Nebraska. Within ten (10) days
<br />thereafter, a copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to all
<br />parties entitled to notice, pursuant to said Decd of Trust and in compliance with Neb. Rev. Stat. § 76-
<br />1008 (Reissue 1996).
<br />(3) That Truster, Claude Rinke, a single person, failed to cure the default referenced in the
<br />Notice of Default within 30 days after the recording of the Notice of Default.
