<br />TRUST DEED TO NEW TRUST DEED 200200973
<br />Agreement made the 18TH day of JANUARY — 2002, between Raymond H. Evans
<br />and Iva K. Evans, Husband and Wife of 1269 E. White Cloud Rd., Grand Island, Hall County,
<br />State of Nebraska, herein referred to as truster, and The Equitable Building & Loan Association,
<br />a Federal Savings Bank, now known as EQUITABLE FEDERAL SAVINGS BANK OF
<br />GRAND ISLAND, of 113 N. Locust St., City of Grand Island, County of Hall, State of
<br />Nebraska, herein referred to as beneficiary.
<br />The parties recite and declare that:
<br />a. Trustor executed a trust deed on January 4, 2001, in favor of beneficiary, which was
<br />recorded on January 12, 2001, in the office of the Register of Deeds, of Hall County, State of
<br />Nebraska, covering the following described property (as defined in Neb. Rev. State. 76 -201) in
<br />Hall County, Nebraska.
<br />A tract of land In the North Half of the Northwest Quarter (N1/2NW3 /4) of Section Twenty -seven (271
<br />in Township Twelve (12) North, Range Nine (9) West of the Sixth P.M., more particularly described as
<br />follows: Starting at a point an the North Section line of said Section 27, which point Is 1322.9 feet
<br />East of the Northwest corner of said Section 27; thence East on the mid Section line a distance of
<br />199.3 feet; thence turning and running Southerly a distance of 1311.5 feet on a line parallel to the
<br />right of way line of the Union Pacific Railway Company; thence burring and running West a distance of
<br />199.3 feet; thence turning and running Northerly a distance of 1311.0 feet to the point of beginning.
<br />b. The above mentioned trust deed was given as security for Loan, described in such
<br />trust deed, in the original amount of Twelve Thousand Seventy Two and 50/100 - -- ($12,072.50)
<br />Dollars, executed on January 4, 2001, by trustor in favor of beneficiary.
<br />c. Trustor desires to obtain a loan in the amount of Eighty Thousand and No /100
<br />($80,000.00) -- - - - - -- from Equitable Federal Savings Bank of Grand Island, of 113 N. Locust,
<br />City of Grand Island, County of Hall, State of Nebraska, herein referred to as lender, but lender
<br />requires that such loan be secured by a trust deed that will be prior to the trust deed in favor of
<br />beneficiary.
<br />d. Beneficiary is willing to subordinate the lien of the trust deeds in their favor insofar as
<br />it encumbers the above - described premises, to the trust deed made in favor of lender
<br />in order that truster may obtain such loan from lender. Said Deed of Trust securing
<br />lender's lien was recorded onA t k, r i aN b as document no. J66 3 - 71
<br />in the Office of the Hall County Register of Deeds.
