<br />Consideration: Promissory Note given by Trustor to Beneficiary for

<br />Trustor, in consideration of the sum of $27,900.00, receipt of which is hereby
<br />acknowledged, conveys to Trustee, in trust, with power of sale all of Lot 33 Grand West
<br />Subdivision to the City of Grand Island, Hall County, Nebraska (the "Property").
<br />Trustor covenants that Trustor is lawfully seised of such Property and that it is
<br />free from encumbrance, sub'ect, however, to a certain Trust Deed dated January 1 � ,
<br />2002 given by Trustor to j4,-, /A Trustee for the benefit of Heritage Bank
<br />and special assessments as of the ate hereof and to existing easements or restrictions of
<br />use or of record; Trustor covenants that Trustor has legal power and lawful authority to
<br />execute this Trust Deed; and Trustor warrants and will defend title to the Property against
<br />the lawful claims of all persons.
<br />Trustor and Beneficiaries covenant and agree as follows:
<br />1. Payment of Note. Trustor shall promptly pay when due the principal of and
<br />interest on the debt evidenced by the Trust Deed and Promissory Note of even
<br />date herewith together with all sums advanced by Beneficiary to protect the
<br />Property, with interest thereon at the default rate provided in the Promissory Note.
<br />2. Taxes & Assessments. Trustor will pay all real estate taxes levied on the
<br />Property, including any tax levied on the debt secured hereby, when they become
<br />due and before they become delinquent. Beneficiary shall pay installments of
<br />special assessments assessed as of the date of this Trust Deed when due.
