<br />THIS DEED OF TRUST is made on this 16th day of January, 2002. The Truster
<br />(whether one or more) is GLENDA L. RATHJEN and LYNN D. RATHJEN, Wife and
<br />Husband, and TAMI BEDNAR and THOMAS D. BEDNAR, Wife and Husband, whose
<br />address for purposes of notices in respect to this Deed of Trust is 3444 S. Stuhr Road,
<br />Grand Island, NE 68801 and is sometimes herein identified as Borrower. The Trustee is
<br />AREND R. BAACK, Attorney at Law and member of the Nebraska State Bar
<br />Association, whose address is P.O. Box 790, Grand Island, NE 68802 -0790. The
<br />Beneficiary (whether one or more) is JAMES D. LIVINGSTON, whose address for
<br />purposes of notification under this Deed of Trust is 4405 Quail Lane, Grand Island, NE
<br />68801 and is sometimes herein identified as Lender.
<br />WHEREAS, the Decd to the property herein described prior to the execution of
<br />this Deed of Trust remained in Escrow pending final payment of all sums evidenced by a
<br />Contract for Sale of Real Estate dated December 29, 1994 between the parties herein
<br />identified;
<br />WHEREAS, the Trustor has requested that the Deed in Escrow be recorded and
<br />that this Deed of Trust be given in substitution of the security previously existing by
<br />reason of such arrangement,
<br />NOW, THEREFORE, the undersigned hereby provide:
<br />BORROWER IRREVOCABLY CONVEYS TO TRUSTEE, IN TRUST, WITH
<br />POWER OF SALE, THE FOLLOWING:
<br />The East One -Half (E 1/2) of Lot Sixteen (16) and Eighteen (18), Block
<br />Five (5) College Addition to West Lawn, in the City of Grand Island, Ilall
<br />County, Nebraska; and
<br />The West One -Half (W 1/2) of Lot Sixteen (16) and Eighteen (18), Block
<br />Five (5), College Addition to West Lawn, in the City of Grand Island, Hall
<br />County, Nebraska
<br />together with all buildings, improvements, fixtures, streets, alleys, passageways, ease-
<br />ments, rights, privileges and appurtenances located thereon or in anywise pertaining
<br />thereto, and the rents, issues and profits, reversions and remainders thereof, and such
<br />personal property that is attached to the improvements so as to constitute a fixture,
<br />including, but not limited to, heating and cooling equipment and together with the
<br />homestead or marital interests, if any, which interests are hereby released and waived, all
<br />of which, including replacements and additions thereto, is hereby declared to be a part of
<br />the real estate secured by the lien of this Deed of Trust and all of the foregoing being
<br />referred to herein as the "Property ".
<br />Borrower owes Lender the remaining principal sum of Seventy -Seven Thousand
<br />Five Hundred Eighty -Six and 14/100 Dollars ($77,586.14) together with interest thereon
<br />accruing from January 1, 2002, evidenced by Borrower's Note of even date herewith
<br />(hereinafter referred to as "Debt ") which has a stated maturity date of December 1, 2004.
<br />This Debt shall include any and all modifications, extensions and renewals thereof or
<br />thereto and any and all future advances and readvances to Borrower (or any of them if
<br />more than one) hereunder pursuant to one or more promissory notes or credit agreements
<br />(herein called "Note ").
