'rl:`S'INDENTURE, Made this 13TH day of NOVEMBER, 2001 between <br />200200330 <br />SCOTT AND LISA NORTON, HUSBAND AND WIFE <br />, part ONE of the first part hereinafter referred to as lessor, and <br />HEALTH PLEX FITNESS CENTER, INC. <br />, part TWO of the second part hereinafter referred to as lessee. <br />WITNESSETH, That the said lessor, in consideration of the covenants of the said lessee, hereinafter set forth, <br />do or does by these presents lease to the said lessee, the following described property, to -wit: <br />LOTS 1, 2 AND NORTH 50' OF LOT 3, BONSALL SUBDIVISION, GRAND ISLAND <br />HALL COUNTY, NE. <br />TO HAVE AND TO HOLD the same unto the said lessee from the 1ST day of DECEMBER <br />, 2001 , to the 1ST day of DECEMBER , 2021 <br />And the said lessee, in consideration of the leasing of the premises as above set forth, covenants and agrees u itl <br />the lessor, to pay the said lessor as rent for the same the sum o f THIRTY TWO HUNDRED AND NO/ 100 <br />ROLI_AR <br />payable as follows, to -wit: <br />LESSEE, IN CONSIDERATION OF LEASING SAID PREMISES AS SET FORTH <br />ABOVE, COVENANTS AND AGREES WITH LESSOR TO PAY AS RENT FOR THE <br />SAME, THE SUM OF $3,200.00 PER MONTH, PAYABLE ON THE FIRST DAY <br />OF THE MONTH. THE ABOVE RENTAL SHALL BE SUBJECT TO ADJUSTMENT <br />FOR REAL ESTATE TAX INCREASE ON AN ANNUAL BASIS, WHEN ANNIVERSARY <br />DATE ARRIVES. TAX INCREASE WILL BE PASSED TO LESSEE ON A MONTHLY <br />BASIS. <br />The said lessee further covenants with the said lessor, that at the expiration of the time mentioned in this lease, <br />peaceable possession of said premises shall be given to the said lessor, in as good condition as they now are, the usual <br />wear, inevitable accidents and loss by fire excepted; and that upon the non- payment of the whole or any portion of <br />the said rent at the time when the same is above promised to be paid, the said lessor may at his, her, their or its <br />election either distrain for said rent due, or declare this lease at an end and recover possession as if the some was <br />held by forcible detainer; the said lessee hereby waiving any notice of such election or any demand for the possession <br />of the said premises. <br />AND IT IS FURTHER COVENANTED AND AGREED between the parties aforesaid <br />THERE SHALL BE ONE FIVE YEAR OPTION TO RENEW THIS LEASE FOR <br />THE ORIGINAL TERMS.
