LICENSE AGREEMENT <br />This License Agreement is made by and between the CITY OF GRAND ISLAND, <br />NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and Gaylord D. <br />Apfel and E. Joan Apfel, husband and wife, hereinafter referred to as the "Licensees." <br />1. STATEMENT OF PURPOSE. The Licensor has recently acquired additional <br />land in Ponderosa Lake Estates Subdivision to expand and widen existing easements which <br />contain private sanitary sewer and water lines that serve the subdivision. As a result of the <br />acquisition of additional land for the easements, various residences, landscaping features and <br />other improvements now encroach upon the easements held by the Licensor. This License <br />Agreement allows the encroachment of existing residences or portions thereof, landscaping <br />features and other improvements on such easement. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensees own the <br />following described real estate adjacent to the Licensor's casement to which this License <br />Agreement shall apply: <br />k <br />Lot 21A, on m ero Lake Lake Estates Subdivision in Grand Island, Hall County, <br />Nebraska <br />3. LICENSEES' DUTIES AND RISKS. It is understood and agreed that the <br />Licensees may maintain, repair and utilize that portion of their residence, landscaping features <br />and other improvements that encroach the Licensor's easement at the date of this agreement at <br />the Licensees' sole risk. The Licensees hereby waive any claim for damages against the <br />Licensor, its officers, employees, agents and independent contractors for any damage or injury <br />that may occur by the Licensor, its employees, agents or independent contractors working for the <br />Licensor during the course of their employment or duties with the Licensor.
