<br />NOTICE IS HEREBY GIVEN that the above -named claimant, POWER Engineers, Inc., 3900
<br />South Wadsworth Blvd., Suite 700, Lakewood, CO 80235, claims a lien upon any and all right, title,
<br />interest, lien, easement, franchise rights, or permits owned or held by Touch America, Inc. and /or
<br />AT &T Corp., AT &T Communications of the Midwest, Inc. and their associated and allied
<br />companies (defined to include American Telephone and Telegraph Company, its parents and
<br />subsidiaries) certain real property located in the state of Nebraska, and more particularly described as
<br />follows:
<br />See attached Exhibit A, together with the underground fiber optic
<br />conduit system running across said real property.
<br />This claim of lien against the above - described real property arises as a result of claimant's
<br />furnishing of engineering services, materials and labor relating to the construction, alteration or
<br />improvement of the above - described real property and/or the underground fiber optic conduit system
<br />situated thereon. This claim of lien is for the value of the claimant's engineering services, materials and
<br />labor, and against the underground fiber optic conduit system being constructed on the premises, the land
<br />upon which the underground fiber optic conduit system is located and a convenient space about the same,
<br />or so much as may be required for the convenient use and occupation thereof.
<br />Claimant supplied said engineering services, materials and labor at the instance and request of
<br />Touch America, Inc., 130 N. Main Street, Butte, MT 59701.
<br />Claimant ceased to provide engineering services, materials and labor on the 22nd day of March,
<br />2003.
<br />There is a balance presently due and owing after the deduction of all proper offsets and credits,
<br />for such engineering services, materials and labor, in the principal sum of $5,201.00, plus interest.
