200308254 <br />NEBRASKA DEED OF TRUST <br />G: y <br />Q - <br />M <br />c� <br />Z <br />W <br />C <br />Z3 <br />F-" <br />C-3 <br />0,1 <br />C7) cn <br />© --i <br />C n <br />Z M <br />--i <br />O <br />O �t <br />n c� <br />r A <br />r n <br />n <br />Cn <br />Cn <br />aAqrin, <br />THIS DEED OF TRUST ( "Deed of Trust ") is made this day of , <br />by BECKY L JANES AND DANIEL L JANES (hereinafter <br />whether on r more a e referred to as the "Grantor "), and <br />MQ,(,/ /�/ AY� y $� /�� � #10i✓ cf7f a domestic corporation as Trustee (the <br />`"Trustee " ")). /V C7 6F � <br />WHEREAS, the Grantor is justly indebted unto _ ER NRUNTWRHERk� J;VPNJUN11RERC (the <br />"Contractor ") in the principal amount of & Dollars <br />($ 4500.00 which principal amount with interest thereon is evidenced by a certain retail installment <br />contract (the "Contract ") by and between the Contractor and the Grantor of even date herewith, and payable in <br />consecutive monthly installments. <br />WHEREAS, the Grantor desires to secure the payment of all sums evidenced by the Contract, and all costs, <br />expenses, charges, liabilities, commissions and attorney's fees now or hereafter chargeable to, incurred by or <br />disbursed by the Trustee, the Contractor or the Grantor as provided herein (collectively, the "Obligations ") and the <br />performance of the terms, conditions and provisions of the Contract and of any other instruments, agreements and <br />documents, contract in connection with the Obligations. <br />NOW, THEREFORE, in consideration of the foregoing, and other good and valuable consideration, the receipt and <br />sufficiency of which are hereby acknowledged, the Grantor does grant, convey and assign to the Trustee, and does <br />hereby grant a lien and security interest to the Contractor and the Trustee and its, their or his assigns, successors or <br />successor, in and on the parcel or parcels of land situated in County, State of <br />Nebraska, and more particularly described as follows: <br />See Attached Legal Description AKA: 2236 WEST 11TH STREET <br />GRAND ISLAND, NE 68803 KEY # 400126613 <br />(the "Land "), together with all improvements and fixtures of every kind and description now owned or which may <br />hereafter be owned by Grantor in and upon said Land, it being understood and agreed between the parties hereto that <br />the word "Property' wherever it occurs in these presents, shall be deemed to include all the equipment, furnishings, <br />and fixtures above mentioned and conveyed, and together with all the improvements now or hereafter in anywise <br />appertaining, and all the estate, right, title, interest and claim either at law or in equity or otherwise, of Grantor, of, <br />in, to, or out of the said Land. <br />TO HAVE AND TO HOLD the Property unto the Trustee, in trust, in fee simple; provided, however: (a) until the <br />occurrence of a default hereunder the Grantor may retain possession of the Property; and (b) if the Grantor shall pay <br />the Obligations in accordance with the terms of the Contract and shall *perform all of the terms, conditions and <br />provisions of the Contract, then this Deed of Trust shall be void, and upon proof given to the satisfaction of the <br />Trustee that the Obligations have been satisfied in full, the Trustee shall (at the expense of the Grantor) release and <br />discharge the lien and terminate the security interest of this Deed of Trust of record. Grantor hereby represents, <br />warrants, covenants and agrees for the benefit of the Contractor and the Trustee that the Grantor has the right and <br />authority to convey the Property with General Warranty and English covenants of title and does hereby warrant <br />specially, and agrees to defend, the Property and the title thereto, whether now owned or hereafter acquired, against all <br />claims and demands of the Grantor and every person claiming or to claim by, through or under the Grantor. <br />O rt <br />N � <br />O CL <br />C <br />C� <br />C C <br />ry 3 <br />cn CD <br />s � <br />0 <br />The Grantor hereby covenants for the benefit of the Contractor and the Trustee as follows: (i) to pay the Obligations, <br />together with all taxes and assessments relating to the Land and the Property when due and payable and to pay all <br />other sums according to the terms and provisions of the Contract; (ii) to punctually observe and comply with the <br />terms conditions and provisions of the Contract to be observed and complied with by the Grantor; (iii) to punctually <br />observe and comply with the terms. conditions and provisions under any mortgage, deed of trust or other security <br />agreement with a lien which: ha „pri rity over this Deed of Trust to be observed and complied with by the Grantor; <br />(iv) to keep the Property in$ g condition and repair as it is now and will not commit or permit any waste <br />thereof, reasonable wear an tear Excepted; (v) the Grantor will not act or fail to act in any manner which will <br />jeopardize the lien of this Deed of Trust;
