O O to it paid by the STATE OF NEBRASKA, DEPARTMENT OF ROADS, Grantee, and the promises of the Grantee hereinafter specified, does hereby (i) remise, release and quitclaim unto the Grantee, its successors and assigns, the PERMANENT RIGHTS for highway purposes in and to the property that is described in Exhibit "A ", hereto attached, and depicted on Exhibit "C ", hereto attached as permanent rights, and (ii) grant TEMPORARY CONSTRUCTION RIGHTS to the Grantee upon, along and across the property that is described in Exhibit "B ", hereto attached, depicted and shown on Exhibit "C ", hereto attached, as temporary construction rights, with such temporary rights commencing on the date of this Agreement and continuing until the Grantee no longer needs such property in connection with Project No. S- 30- 4(1027). The Grantee shall notify the Grantor when work has been completed and that the premises are no longer needed by the Grantee for temporary construction purposes, subject to the terms and conditions hereafter set forth. RESERVING, however, unto the Grantor, its licensees, lessees, successors and assigns the right to construct, maintain, use, operate, relocate, reconstruct and renew such tracks and facilities as it may at any time, and from time to time, desire within the limits of the land herembefore described, including the right and privilege to use land for any and all purposes, not inconsistent with the use thereof for highway purposes. The foregoing right is made subject to and upon the following express conditions: 1. To existing interests in the above described premises to whomsoever belonging and of whatsoever nature and any and all extensions and - newals thereof, including but not limited to underground pipe lines or lines, or any type of wire line or lines, if any. 2. Any and all cuts and fills, excavations or embankments necessary in the construction, maintenance, or future alteration of said highway shall be made and maintained in such manner, form and extent as Sheet 1 of 6
