<br />Hall County, Nebraska, described as follows: Beginning at a point on the South line of
<br />Anna Street in the City of Grand Island, Hall County, Nebraska, 203.1 Feet Easterly from
<br />the intersection of said South line of Anna Street and the East property line of the county
<br />road which is located on the approximate North and South center line of the South Half of
<br />the Northwest Quarter (S1/2 NW1 /4) of said Section Twenty -One (21); running thence
<br />Easterly along the South line of Anna Street 90.4 Feet; thence Southerly at right angles to
<br />Anna Street 132 Feet; thence Westerly parallel to the South line of Anna Street 90.4 Feet;
<br />thence Northerly 132 Feet to the place of beginning.
<br />This conveyance is made pursuant to the powers conferred on Grantor by a trust deed filed for record on
<br />May 12, 1995, in the Register of Deeds of Hall County, Nebraska, as Document No. 95- 103127, executed
<br />by David E. Swanson and Pamela J. Swanson, husband and wife, are Trustors, and The Equitable
<br />Building and Loan Association Federal Savings Bank, predecessor to Equitable Federal Savings Bank of
<br />Grand Island, Nebraska, is named Beneficiary and Earl D. Ahlschwede, Attorney, is Trustee, wherein the
<br />Trustors granted and conveyed to such Trustee, on the trust therein expressed, the property above
<br />described to secure, among other obligations, payment of a promissory note of even date in the principal
<br />amount of $88,000.00 and interest thereon according to the terms thereof; and after the fulfillment of the
<br />conditions specified in the Trust Deed authorizing this conveyance as follows:
<br />1) Breach and default were made under the terms of the Trust Deed in the particular set forth in
<br />the notice of default hereinafter referred to, which default continued until the time of sale.
<br />2) There was filed for record on March 3, 2003, a Notice= of Default with the Register of Deeds of
<br />Hall County, Nebraska, as Document No. 200302452 and of election to sell the property to satisfy the
<br />obligations secured thereby and thereafter notice of the filing of the notice of default was sent in the
<br />statutory manner to all persons entitled to a notice thereof.
<br />3) That thereafter the Grantor executed his notice of trustee's sale, stating that he, as trustee,
<br />would sell at public auction to the highest bidder the property hereinbefore described, fixing the time and
<br />place of the sale as May 20, 2003 at 10:00 a.m. in the lower level lobby of the county courthouse in Grand
<br />Island, Hall County, Nebraska, and caused copies of such notice to be published once a week for five
<br />consecutive weeks in THE GRAND ISLAND INDEPENDENT, a legal daily newspaper printed, published
<br />and of general circulation in the County of Hall, Nebraska, the first date of publication was April 8, 2003,
<br />and the last date of publication was May 6, 2003; notice of such trustee sale was sent to the Trustors and
<br />al! persons entitled to notice thereof in accordance with applicable law.
<br />4) All applicable statutory provisions of the State of Nebraska and the United States of America
<br />and all provisions of such trust deed have been complied with as to the acts to be performed and notices
<br />to be given.
<br />The trustee at the time and place of sale fixed as aforesaid, then and there sold, at public auction,
<br />to Grantee, who was the highest bidder therefore, the property hereinbefore described for the sum of
<br />$86,101.00. ^
