<br />An Ordinance of the City of Wood River, Nebraska, providing for the vacating of a dedicated
<br />drainage casement on platted lots; to provide for the recording of this Ordinance and indexing the same
<br />against the real estate and lots affected; to provide that the owner or owners of the lots affected by the
<br />va,,mo n of the easement shall be free after the effective date of this Ordinance to use, occupy, and convey
<br />said lots without restrictions contained within any such easement; and to provide an effective date of this
<br />Ordinance.
<br />WHEREAS, the City Council of the City of Wood River, Nebraska, is authorized by Nebraska
<br />Law to vacate all or parts of platted easements contained within the Municipality; and,
<br />WHEREAS, the City Council of the City of Wood River, Nebraska, has been requested by the
<br />owners of Lots Fourteen (14) and Fifteen (15), Thelen Subdivision, First Addition, in the City of Wood
<br />River, Hall County, Nebraska, to vacate a platted and dedicated drainage casement along the boundary line
<br />of Lots Fourteen (14) and Fifteen (15), in said subdivision; and
<br />WHEREAS, the platted easement for which vacation has been requested does not contain any
<br />public utilities at the present time, and the City Council has been advised by the City's Engineer that future
<br />use and expansion will not require the use of said easement for drainage purposes.
<br />BE IT, THEREFORE, ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
<br />OF WOOD RIVER, NEBRASKA.
<br />Section 1. That the easement along the boundary lines between Lots Fourteen (4) and Fifteen (15)
<br />of Thelen Subdivision, First Addition to the City of Wood River, Nebraska, heretofore reserved
<br />for sixteen foot (16') wide drainage easement, be, and the same hereby is vacated. That all
<br />reservations of the use of said easement area for drainage is tetntinated, and the sole and exclusive
<br />use of said area shall revert to the owner or owners of said Lots Fourteen (14) and Fifteen (15),
<br />Thelen Subdivision, First Addition to the City of Wood River, Nebraska.
<br />Section 2. That the Wood River City Clerk, be, and hereby is authorized to cause copy of this
<br />Ordinance to be recorded in the OtSee of the Hall County register of Deeds to be indexed against
<br />the real estate described herein.
<br />Section 3. That all ordinances and parts of ordinances in conflict herewith are hereby repealed.
<br />Section 4. That this ordinance shall be in full force and take effect upon its pas age and
<br />publication as provided by law.
