200305844 <br />rendered or upon the death of the parties, whichever first occurs. If the decree becomes final and <br />operative upon the death of one of the parties, the decree shall be treated as if it became fmal and <br />operative on the date it was rendered. <br />2. Both parties have exhibited unique attributes which are vital to the well being of the <br />children. Petitioner has provided a consistent and stable home for the children and has been the main <br />source of fmancial support for them. IIe has been the children's consistent parent during this last <br />yew when the respondent has chosen to leave the family to move to Washington or Canada without <br />any verifiable job or source of income. Petitioner has provided the children with transportation to <br />school, proper supervision for the children after school until he picks them up, and has been involved <br />in their activities. Respondent has now chosen to return to Nebraska with her boyfriend to live. She <br />has no stable /steady income at this fime. To the respondent's credit, she has maintained contact with <br />the children during her absence from the State and has exercised extended summer visitation. <br />While still living with the family, respondent did not work full time outside the home and <br />was the primary caretaker of the children. Even while the parties were separated and during the <br />custody dispute, the parties have managed to work together on frequent exchanges of the children, <br />sometimes even daily, and have spent time together in the home when respondent visited Nebraska <br />and to celebrate Father's Day. <br />The personalities of the parties are at different ends of the spectrum and both offer the <br />children important qualities. Because the history has shown, that despite a potentially volatile <br />custody battle, the parties can work together for the sake of the children, it is in the children's best <br />interest that custody be awarded jointly to the parties. <br />Petitioner shall provide the primary residence during the school year and respondent shall <br />-3- <br />
