"Property" is defined in Granting Clause II. 200305579 <br />"Receiver" is defined in Section 5.04(d). <br />"Reimbursement Obligations" is defined in Recital A. <br />"Rents" is defined in Granting Clause VII. <br />"Restoration" means the restoration, repair, replacement or rebuilding of <br />the Improvements and the Equipment after a Casualty or Condemnation and <br />"Restore" means to restore, repair, replace or rebuild the Improvements and the <br />Equipment after a Casualty or Condemnation, in each case as nearly as possible to <br />its value and condition immediately prior to such Casualty or Condemnation. <br />"Secured Obligations" is defined in Recital D. <br />"Secured Parties" is defined in Recital D. <br />"Security Deposit" means any payment, note, or other security or deposit <br />made or given by or on behalf of a tenant under a Lease as security for the <br />performance of its obligations thereunder and any interest accrued thereon. <br />"Subsidiary Guarantor" is defined in Recital C. <br />"Subsidiary Guaranty" is defined in Recital C. <br />"Trust Property" is defined in the Granting Clauses. <br />"UCC" means the Uniform Commercial Code as in effect in the State in <br />which the Trust Property is located provided that if by reason of mandatory <br />provisions of law, the perfection or the effect of perfection or non perfection or <br />the priority of any Lien granted in any Collateral under this Deed of Trust is <br />governed by the Uniform Commercial Code as in effect in a jurisdiction other <br />than the State in which the Trust Property is located, "Uniform Commercial <br />Code" means the Uniform Commercial Code as in effect in such other jurisdiction <br />for purposes of the provisions hereof relating to such perfection, effect of <br />perfection or non perfection or priority. <br />"Unavoidable Delays" means delays due to acts of God, fire, flood, <br />earthquake, explosion or other Casualty, inability to procure or shortage or labor, <br />equipment, facilities, sources of energy (including electricity, steam, gas or <br />gasoline), materials or supplies, failure of transportation, strikes, lockouts, action <br />of labor unions, Condemnation, inability to obtain permits or other causes beyond <br />the control of the Grantor, provided that lack of funds shall not be deemed to be a <br />cause beyond the control of the Grantor. <br />Section 1.02. Interpretation.
