200305463 <br />23. NOTICE. Unless otherwise required by law, any notice shall be given by delivering it or by mailing it by to, first class mail to the <br />appropriate party's address on page 1 of this Security instrument, or to any other address designated in waiting. Notice to one <br />trustor will be deemed to be notice to all Trustors. <br />26. WAIVERS. Except to the extent prohibited by law, Tmstor waives any right regarding the marshalling of liens acrd assets, and <br />bercby releases and waives all rights under and by virtue of the homestead exemption laws of this state. <br />27. OTHER TERMS. If checked, the following are applicable to this Security Instrument: <br />It Line of Credit. The Secured Debt includes a revolving line of credit provision. Although the Secured Debt maybe <br />reduced to a zero balance, this Security Instrument will remain in effect film] released. <br />iFLI Construction Loan. 'Phis Security Instrument secures an obligation incurred for the construction of an improvement on <br />the Property. <br />D Fixture Filing. Truster grants to Beneficiary a security interest in of goods (hat Truslor owns now or in the future and <br />that are or will become fixtures related to the Property. This Security Instrument suffices as a fuancing statement and <br />any carbon, photographic or other reproduction may be filed of record for purposes of Article 9 of the Uniform <br />Commercial Code. <br />0 Additional Terms. <br />28. STATEMENT OF CONDITION. From time to time, as required by law, Beneficiary shall furnish to Trustor or its agent such <br />statements as may be required concerning the condition of the Secured Debt. Beneficiary, will charge a fee for such statements as <br />may he permitted by law. <br />29. RECONVEYANCE. Upon payment of all sums secured by this Security instrument, Beneficiary shall request Trustee to reconvev <br />the Property and shall surrender this Security Instrument and any note or instrument evidencing (he Secured Debt to the Trustee. <br />Trustee shall reconvcy, without warranty, the Property or that portion secured by this Security Instnnncnl. To the extent permitted <br />by lmv, the reconvcyance may describe the graumee as "the person or persons legally entitled thereto" Neither Beneficiary nor <br />Trustee shall have any duty to determine the rights of persons claiming to be rightful grantees of any reconveyance. Beneficiary <br />will charge a fee for such reeonvevance as may be permitted by law. <br />30. RIDERS.
