('lender ") and Five Points Bank with offices at <br />2015 N Broadwell Ave., Grand Island, NE 68803 <br />WHEREAS, Bank is the beneficiary under a Trust Deed date l March 12, 2002 and <br />recorded May 6, 2002 in Instrument # 0200204837, in the amount of 14 2, 93.94, of the Mortgage <br />Records of Hall County, Nebraska, to secure a loan to Jeffrey L. Roliy and Angela L. Roby, <br />husband and wife, ("borrowers ") and covering the following described real estate: <br />Lot thirty -nine, (39) Castle Estates Subdivision to the CHy of Grand Island, Hall County, <br />Nebraska. <br />WHEREAS, Lender proposes to make a loan to Borrowers not to exceed the principal <br />amount of $97,500.00 to be secured by a first mortgage or trust deed up(in real estate covered by <br />the Trust Deed of the Bank and described as above, and <br />WHEREAS, Lender has requested Bank and Bank has agreed to subordinate the lien of <br />its Trust Deed to the mortgage of trust deed to be taken by Lender,. <br />NOW, THEREFORE, in consideration of the premises the parties agree as follows: <br />Bank hereby expressly subordinates the lien of the above described Trust Deed to the lien <br />of any mortgage or trust deed taken by Lender from Borrowers and declsiwes the lien of the Trust <br />Deed to be junior and inferior to the lien of Lender upon the lands described therein; provided, <br />however, that the subordination of the Trust Deed of Bank shall not apply or be effective as to <br />any amount, exclusive of interest, in excess of $96.500.00 secured by the mortgage or trust deed <br />of Lender. <br />..........
