200303034 <br />EXTENSION AGREEMENT FOR PAYMENT <br />OF NOTE - SECURED BY DEED OF TRUST <br />THIS AGREEMENT made in Boelus, Nebraska, by and between the <br />Boelus State Bank, by its President, Russell K. Jensen, party of <br />the first part, and Richard D. Plambeck and Penny J. Plambeck, <br />husband and wife, party of the second part. <br />WHEREAS, the Second Party represents and warrants that they <br />already made, executed and delivered to the First Party a certain <br />promissory note with an unpaid principal balance of Forty -Five <br />Thousand Fifteen Dollars and 57/100 Dollars - - -- ($45,015.57) plus <br />accrued interest, dated February 28, 2000 and payable to the <br />order of the First Party on February 28, 2003. <br />The Second Party further represents and warrants that to <br />secure the payment of the note, with interest as provided, the <br />Second Party duly made, executed, acknowledged and delivered to <br />the First Party a certain deed of trust dated February 28, 2000 FILED 3/1/00 <br />irrevocably grants and conveys to the First Party the following INSTRUMENT # <br />described premises: 200001679 <br />Lot Thirteen (13) and the West Half (W h) of Lot Twelve <br />(12), in Meadow Lane Fourth Subdivision, Hall County, <br />Nebraska. <br />The Second Party further represents and warrants that they <br />are now owner of the above described land in fee simple, subject <br />to the above described deeds of trust, and the First Party is the <br />legal owner and holder of the aforesaid promissory note. <br />The Second Party desires to have the time for the payment of <br />the note and mortgage extended until February 28, 2006 from the <br />date of this agreement. <br />It is mutually agreed that: <br />1. The First Party will extend the payment of the promissory <br />note until February 28, 2006 from the date of this agreement so <br />long as the Second Party shall pay interest from the date of this <br />agreement at a variable rate of interest of 7.008. Variable <br />interest rate of interest to be 0.258 above Chase Manhattan Prime <br />Lending Rate (4.25% Chase Manhattan Prime Lending Rate + 0,258 <br />with a minimum rate of 7.008 per annum) with a minimum rate of <br />7.008 per annum, payable in thirty -five monthly installments of <br />$378.02 each beginning March 28, 2003 and monthly thereafter with <br />a balloon payment of $40,790.05 due February 28, 2006. The <br />interest rate is variable on an annual basis from the date of <br />this agreement. <br />All covenants, stipulations and agreements of the note and deeds <br />of trust shall continue in force and effect. The total finance <br />charge is Nine Thousand Five and 16/100 Dollars ($9,005.16). <br />
