200`9'0029 200303031 <br />after the same is due or to be performed, then the Seller shall <br />give Buyer written notice of such default, and if such default <br />is not corrected within five (5) days after date of said written <br />notice, then the Seller may elect to declare a default and the <br />entire unpaid principal balance and accrued interest, together <br />with any advances and payments made by Seller on behalf of <br />Buyer, shall become immediately due and payable at the option <br />of the Seller without further notice or demand, and the Seller <br />may proceed to foreclose this Contract as provided by law, or <br />take such other and further legal action as may be available to <br />them. <br />(10) Waiver_. Any waiver by the Seller of the time or manner <br />of payment due hereunder or the time or manner of performance of <br />acts required hereunder of the Buyer on one occasion, shall not <br />constitute a waiver or relinquishment of any right of the Seller <br />to demand subsequent payments when due, or to demand performance <br />by the Buyer in accordance with the terms of this Agreement on <br />any other or subsequent occasion. <br />(11) Obligations of the Buyer. The Buyer agrees to pay the <br />real property taxes and provide insurance as above set forth, and <br />further agree to keep all improvements on the property in good <br />condition and repair, ordinary wear and depreciation excluded, and <br />agree not to destroy, remove or substantially remodel any <br />improvement without the prior written consent of the Seller. <br />Buyer further agrees to keep said property free and clear of all <br />liens, taxes and encumbrances at all times during the term of this <br />Contract. In the event that the Buyer should abandon said <br />property, then the Seller may take immediate possession of said <br />property, and such further action available to him. <br />(12) Assignment. Buyer agrees not to sublet the personal <br />property, and further agree not to assign this Contract without <br />the prior written consent of the Seller, which consent shall not <br />be unreasonably withheld. Any attempted assignment of the <br />Contract or surrender of the premises contrary to the terms <br />hereof shall render the unpaid balance due hereunder immediately <br />due and payable in full at the option of the Seller. The Buyer <br />further agrees not to pledge, mortgage, alienate or in any way <br />encumber said property without the written consent of the <br />Seller, and any attempt to do so shall be null an void and <br />likewise render the entire unpaid principal balance and interest <br />immediately due and payable at the option of the Seller. <br />(13) Escrow of the Deed. Seller is the owner and has good and <br />marketable title to the personal property referred to hereinabove, <br />free of all debts and encumbrances. Upon execution of this <br />Contract, the Seller will execute a Deed, which will be delivered <br />to Buyer upon payment of all of Buyer's obligations hereunder. <br />-3- <br />
