The southerly Forty -four feet (44')of Lot Four (4) in Block Seventy -four (74) in the Original <br />Town of Grand Island, now City of Grand Island, Hall County, Nebraska. <br />together with all buildings, improvements, fixtures, and appurtenances located thereon. <br />Grantor covenants with Grantee that Grantor is lawfully seized of such real estate and that the <br />real estate is free from encumbrance, except encumbrances of record; has legal power and lawful <br />authority to convey the real estate; warrants and will defend the title to the real estate against the lawful <br />claims of all persons. <br />Non-Merger Grantor and Grantee acknowledge and agree that this Deed in Lieu of <br />Foreclosure does not merge the fee simple title of the real estate with the lienhold interest of Farmer's <br />State Bank by reason of a Deed of Trust recorded as instrument number 0200202600, at the office of <br />the Register of Deeds of Hall County, Nebraska, on March 8, 2002.
