O <br />WHEREAS, MicTirst Bank is the Holder of that certain Deed of Trust executed by KAYLYNN E. HAYES AND GREGORY <br />E. HAYES filed of record in Hall County on January 22, 2003 as Instrument 60200300828. <br />WHEREAS Gregory E. Hayes has applied to COMMERCIAL FEDERAL BANK for that certain from in the amount of <br />$73,200.00 dated d -1 F- d(Z:.3 <br />1.) The property is described as follows: LOT SEVEN (7), IN CAPIT,%L HEIGHTS SIXTH SUBDIVISION, HALL <br />COUNTY,NEBRASKA <br />AKA 4202 TEXAS AVENUE, GRAND ISLAND, NEBRASKA 68803 <br />2) the Holder vow owns and holds the following Deed of [rust and the bond or note which it secures Deed of Trust dated <br />January 2, 2003 made by Kaylnn E. Hayes and Gregory E. Hayes, wife and husband in the amount of $29,368.00 plus <br />interest, and recorded as Instrument 40200300828 in the clerk office of Hall County, State of Nebraska. <br />3) The owner ofthe Property has executed and delivered a New Deed of trust to COMMERCIAL FEDERAL BANK <br />to secure indebtedness in an amount of $73,200.00 plus interest, covering the property and recorded as Instrument <br />B4m3 -6di88 ofthe records of Hall County, State of Nebraska. The property is more fully described in the New Deed of <br />Trust. <br />4) The Creditor will not accept the New Deed of Trust unless the Existing Deed of Trust is Subordinated to the New Deed <br />of Trust. In exchange for One Dollar ($1.00) and other good and valuable consideration and to induce Creditor to accept the <br />New Deed of Trust, the Holder agrees to subordinate the lien ofthe Existing Deed of Trust to the lien ofthe New Deed offal <br />5) The Existing Deed of rest lien shall be subject, subordinated and inferior in priority to the Deed of Trust in the <br />amount secured by the New Deed of trust, interest, and advances already paid and to be paid in the future under the New Deed <br />of Trust Examples ofthe Advances are brokerage commissions, fees for making the loan. mortgage recording tax, documentary <br />stamps, fee for examination of title and surveys. Advances may be paid without notice to Lender. The maximum amount ofthe <br />lien ofthe existing Deed of Trust that is subordinated is the amount secured by the new Deed of Trust and interest. The <br />Subordination Agreement shall apply to any extension, renewal or modification ofthe New Deed of Trust. <br />This Agreement cannot be changed or ended except in writing signed by Holder and Creditor. <br />7) Ifthere is more than one Holder, each shall be separately liable, the words' Holder" and' Creditor' shall include their <br />heirs, executors, administrators, successors and assigns.
