200302018 ORDINANCE NO. 454 An Ordinance of the City of Wood River, Nebraska, providing the vacating of a utility easement on platted lots; to provide for the recording of this Ordinance and indexing the same against the real estate and lots affected; to provide that the owner or owners of the lots affected by the vacation of the easement shall be free after the effective date of this Ordinance to use, occupy and convey said lots without restrictions contained within any such easement; and to provide an effective date of this Ordinance. WHEREAS, the City Council of the City of Wood River, Nebraska, is authorized by Nebraska law to vacate all or part of platted lots or easements contained therein, and WHEREAS, the City Council of the City of Wood River, Nebraska, has been requested by the owner of Lots Thirty -Four (34) and Thirty -Five (35), Thelen Subdivision, First Addition, in the City of Wood River, Nebraska, to vacate a platted easement along the boundary line of Lots Thirty -Four (34) and Thirty -Five (35) in said subdivision, and WHEREAS, the platted easement for which vacation has been requested does not contain any public utilities at the present time and future use and expansion of utilities will not require the use of said easement. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF WOOD RIVER, NEBRASKA: Section 1. That the easement along the boundary lines between Lots Thirty -Four (34) and Thirty -Five (35) of Thelen Subdivision, First Addition, to the City of Wood River, Nebraska, heretofore reserved for placement of public utilities, be and the same hereby is vacated. That all reservations of the use of said easement area for the placement of public utilities is terminated and the sole and exclusive use of said area shall revert to the owner or owners of said Lots Thirty -Four (34) and Thirty -Five (35). Section 2. That the Wood River City Clerk be and hereby is authorized to cause a copy of this Ordinance to be recorded in the Office of the Hall County Register of Deeds to be indexed against the real estate described herein. Section 3. That all Ordinances and parts of Ordinances in conflict herewith are hereby repealed. Section 4. That this Ordinance shall be in full force and take effect upon its passage and publication as provided by law. Enacted this 10th day of February 2003. , 7 Attest: City Clerk
