200301989 <br />PERPETUAL EASEMENT <br />Grantor, Kenton Jones, owner of Lot One (1) Indianhead Second Subdivision, Grand Island, <br />Hall Cpunty, Nebraska, for itself, it successors, grantees, heirs and assigns for the consideration <br />of One Dollar (S 1.00) and other valuable consideration, receipt of which is hereby <br />acknowledged, does hereby grant a perpetual easement to hndianhead Golf Club, L.L.C., and its <br />grantees, successors, heirs and assigns, an easement for the erection and maintenance of an <br />electrically lighted sign to indicate the location of Indianhead Subdivision and Indianhead Golf <br />Club, which easement shall be located over and across that portion of Grantor's real estate <br />legally described as: <br />Starting at the Southwest (SW) corner of Lot One (1), Indianhead Second Subdivision at <br />the point of begimring then traversing along the lot line North at a distance of Thirteen <br />(13) feet, and then turning right 90 degrees and traversing East a distance of Three (3) <br />feet, hence turning Right 90 degrees and traversing South a distance of Thirteen (13) <br />feet, to the South lot line of Lot One (1) and then turning Right 90 degrees and <br />traversing West a distance of Three (3) feet, back to the point of beginning. <br />Grantor grants to Grantee an easement to the above described real estate for the purpose of <br />erecting and maintaining a lighted sign upon the easement for the purpose of advertising the <br />location of Indianhead Subdivision and Indianhead Golf Course. All costs associated with the <br />erection and upkeep of the sign shall be at the Grantee's expense. <br />Grantor further agrees that Grantor and its grantees, heirs and assigns, shall not plant any plants, <br />bushes, greenery or shrubbery or install any fence that will visually block the view of the sign <br />upon the easement as it is viewed from the highway which lies directly south of this tract. <br />As additional consideration for this agreement, Indiauhead LLC and its grantees, heirs and <br />assigns shall maintain the sign, in good repair and shall maintain the public right -of -way, <br />between the sign and Schroeder Avenue.
