200301989 PERPETUAL EASEMENT Grantor, Kenton Jones, owner of Lot One (1) Indianhead Second Subdivision, Grand Island, Hall Cpunty, Nebraska, for itself, it successors, grantees, heirs and assigns for the consideration of One Dollar (S 1.00) and other valuable consideration, receipt of which is hereby acknowledged, does hereby grant a perpetual easement to hndianhead Golf Club, L.L.C., and its grantees, successors, heirs and assigns, an easement for the erection and maintenance of an electrically lighted sign to indicate the location of Indianhead Subdivision and Indianhead Golf Club, which easement shall be located over and across that portion of Grantor's real estate legally described as: Starting at the Southwest (SW) corner of Lot One (1), Indianhead Second Subdivision at the point of begimring then traversing along the lot line North at a distance of Thirteen (13) feet, and then turning right 90 degrees and traversing East a distance of Three (3) feet, hence turning Right 90 degrees and traversing South a distance of Thirteen (13) feet, to the South lot line of Lot One (1) and then turning Right 90 degrees and traversing West a distance of Three (3) feet, back to the point of beginning. Grantor grants to Grantee an easement to the above described real estate for the purpose of erecting and maintaining a lighted sign upon the easement for the purpose of advertising the location of Indianhead Subdivision and Indianhead Golf Course. All costs associated with the erection and upkeep of the sign shall be at the Grantee's expense. Grantor further agrees that Grantor and its grantees, heirs and assigns, shall not plant any plants, bushes, greenery or shrubbery or install any fence that will visually block the view of the sign upon the easement as it is viewed from the highway which lies directly south of this tract. As additional consideration for this agreement, Indiauhead LLC and its grantees, heirs and assigns shall maintain the sign, in good repair and shall maintain the public right -of -way, between the sign and Schroeder Avenue. Grantor grants to Indianhead LLC, its grantees and assigns continuing access to the sigh of maintenance, repairs and upkeep. By this agreement, the parties understand and agree that the current size and configuration of the sign may change in the future, but the location of the sign and the easement granted herein shall remain, notwithstanding a change in the size or configuration of the sign in the future. This easement shall rout with Grantor's real property and shall be binding upon Grantors, their subsequent grantees and any successors, assigns, heirs and devisees.
