<br />WARRANTY DEED
<br />1.
<br />The City of Grand Island, Nebraska,
<br />by action of
<br />its City Council on
<br />November 26, 2002,
<br />enacted Ordinance No. 8786 which directed
<br />the conveyance
<br />of the real
<br />estate described below and the manner and terms thereof.
<br />2. Ordinance No. 8786 was published in the Grand Island Independent
<br />according to law on December 2, 2002, and notice of such sale and the terms thereof was
<br />published in the Grand Island Independent, a newspaper published in and of general circulation
<br />in Grand Island, Hall County, Nebraska, for three consecutive weeks, on December 3, December
<br />10, and December 17, 2002, all as required by Section 16 -202, R.R.S. 1943, as amended.
<br />3. No remonstrance against such sale was filed with the City Council of the
<br />City of Grand Island, Hall County, Nebraska, within thirty days of the passage and publication of
<br />Ordinance No. 8786.
<br />4. Section 5 of Ordinance No. 8786 provides that if no remonstrance is filed
<br />against such conveyance, the Mayor and City Clerk shall make, execute, and deliver to Proeon
<br />Development Company, L.L.C., a Nebraska Limited Liability Company, a warranty deed for
<br />said real estate, and the execution of such deed is hereby authorized without further action on
<br />behalf of the City Council.
<br />5. NOW, THEREFORE, the CITY OF GRAND ISLAND, NEBRASKA, a
<br />municipal corporation in Hall County, Nebraska, as Grantor, in consideration for such
<br />conveyance of One Thousand One Dollars ($1,001.00), received from the Grantee, hereby
<br />grants, bargains, sells, conveys, and confirms unto
<br />PROCON DEVELOPMENT COMPANY, L.L.C.,
<br />A Nebraska limited liability company, the following described real estate:
