<br />KNOW ALL MEN BY THESE PRESENTS that the undersigned, JACK D. O'HARA
<br />and DEANNE. L. O'HARA, husband and wife, for consideration of One Dollar ($1) and other S
<br />and good consideration receipt of which is hereby acknowledged, do hereby grant unto
<br />Andersen Limited, a Nebraska Partnership, whose address is 4600 N. 2od Avenue, Kearney, NE �e
<br />68847 and to its successors and assigns, a permanent right, privilege, and easement of right of
<br />way to construct, operate, maintain, inspect, repair, remove, alter, and reconstruct utilities over
<br />and upon the following described real estate:
<br />See Exhibit "A"
<br />Andersen Limited shall have the right of ingress and egress across and along the property
<br />within the easement area for the purpose of operation, maintenance, inspection, repair, removal,
<br />alteration, and reconstruction of the utifities located thereon or thereunder.
<br />In further consideration of such grant, Andersen Limited, agrees that it will repair or pay
<br />for any damages which may be caused to the property of the undersigned by the construction,
<br />maintenance, inspection, repair, removal, alteration, or reconstruction of the utilities located
<br />thereon or thereunder. Andersen Limited agrees to take all reasonable steps to restore as nearly
<br />as possible to the condition that itwas prior to the construction, maintenance, repair, removal,
<br />alteration, or reconstruction of such utilities, all land in the easement area which is damaged as
<br />a result of such activities or any of them.
<br />The undersigned covenants that they are the owner of the above - described land subject
<br />only to mortgages and deeds of trusts of record, if any.
