<br />That a Decd of Trust was made and entered into on or about January 31, 1994, by and between Charles D.
<br />Krueger and Jacqulyn S. Krueger, as husband and wife, as Trustors, and Home Federal Savings and Loan
<br />Association of Grand Island, Beneficiary, wherein Arend R. Baack, Attorney was named Trustee. This Decd of
<br />Trust was recorded February I, 1994 in the Records of the Register of Deeds of Hall County, Nebraska as
<br />Instrument No. 94- 100907.
<br />On or about January 31, 1994, Home Federal Savings and Loan Association of Grand Island, Beneficiary,
<br />assigned all of its right, title and beneficial interest in the Deed of Trust to Principal Residential Mortgage, Inc.
<br />The Assignment was recorded February 2, 1994, in the office of the Register of Deeds of Hall County, Nebraska,
<br />as Instrument No. 94- 100954. Said Assignment was rerecorded February 15, 1994, as Instrument No. 94- 101332.
<br />Camille R. Hawk, Attorney at Law, has been appointed Successor Trustee, pursuant to a Substitution of
<br />Trustee filed for record with the Register of Deeds of Hall County, Nebraska. Hereinafter the Successor Trustee,
<br />Camille R. Hawk, Attorney at Law, will be referred to as GRANTOR.
<br />Thu GRANTOR in consideration of Thirty -Two Thousand Seven Hundred Silly -Three Dollars and
<br />Ninety -Five Cents (532,763.95) and other valuable consideration received from Principal Residential
<br />Mortgage, Inc., hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm unto GRANTEE
<br />the following described real property in Hall County, Nebraska:
<br />The West One Half (W 1/2) of Lots Thirty Five (35) and Thirty Six (36), Belmont Addition to
<br />the City of Grand Island, Hall County, Nebraska
<br />'Io have and to hold the above-described premises together with all tenements, hereditamcnts and
<br />appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE'S successors and assigns forever.
<br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors and
<br />assigns:
<br />(1) That Charles D. Krueger and Jacqulyn S. Krueger, as husband and wife, as Trustors, failed to pay
<br />the Beneficiary payments which were contractually due, and the GRANTOR, at the request of the Beneficiary,
<br />elected to declare the entire unpaid principal balance, together with interest thereon, at once immediately due and
<br />payable.
<br />(2) That a Notice of Default was recorded by GRANTOR on October 10, 2002, as Instrument No
<br />2 002 - 1 09 14, in the records of the Register of Deeds, Hall County, Nebraska. Within ten (10) days thereafter, a
<br />copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to all parties entitled to
<br />notice, pursuant to said Decd of Trust and in compliance with Neb. Rev. Staff § 76 -1008 (Reissue 1996).
<br />(3) That Torsions, Charles D. Krueger and Jacqulyn S. Krueger, as husband and wife, failed to true
<br />the default referenced in the Notice of Default within 30 days after the recording of the Notice of Default.
<br />(4) That a Notice of Trustee's Sale was executed by GRANTOR on November 12, 2002. Al least
<br />twenty (20) days prior to the date of sale, a copy of the Notice of time and place of the Trustee's Sale was mailed
<br />by certified mail, postage prepaid, to all parties entitled to notice, pursuant to said Deed of Trust and in
<br />compliance with Neb. Rev. Star. § 76 -1008 (Reissue 1996).
<br />(5) GRANTOR published the Notice of Trustee's Sale, to be held on January 9, 2003 at 10:00 A.M.,
<br />at the lower lobby of the Hall County Courthouse, 111 West First Street, Grand Island, Hall County, Nebraska,
<br />which notice was published in The Grand [stand Independent of Grand Island, Nebraska, once a week for five (5)
<br />consecutive weeks, commencing on November 18, 2002, and ending December 16, 2002. The last publication of
