<br />TRUSTEE'S DEED
<br />This instrument, made this 16' day of January, 2003, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on May 3, 1999 as Instrument No.
<br />99- 104499 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and Federal National Mortgage Association, hereinafter called "Grantee ":
<br />WHEREAS, on October 9, 2002, Eric H. Lindquist, as Successor Trustee, executed a
<br />Notice of Default pursuant to which notice was given to Robert J. Lynn and Lisa K. Spiehs -Lynn,
<br />fikla Lisa K. Spiehs, husband and wife, Trustors, under that certain Deed of Trust recorded on May
<br />3, 1999 as Instrument No. 99- 104499 of the Mortgage Records in the office of the Register of
<br />Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />The Easterly Thirteen (13) Feet and Four (4) inches of Fractional Lot Five (5) and
<br />The Westerly Thirty -Nine (39) Feet and Eight (8) Inches of Fractional Lot Six (6),
<br />in Fractional Block Four (4), Arnold and Abbott's Addition and their complement
<br />to -wit: The Easterly Thirteen (13) Feet and Four (4) Inches of Fractional Lot Nine
<br />(9) and the Westerly Thirty -Nine (39) Feet and Eight (8) hrches of Fractional Lot
<br />Six (6), in Fractional Block Thirteen (13), in Rollin's Addition, both being
<br />Additions to the City of Grand Island, Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on October 22, 2002 as Instrument No. 200211433 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 764008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on November 27, 2002, Grantor caused to be published in
<br />the The Grand Island Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County courthouse, 1" & Locust Street,
<br />Grand island, Hall county, Nebraska, at 10:00 a.m. on January 9, 2003. Publication of such notice
<br />was made for five consecutive weeks on November 27, 2002, December 4, 2002, December 11,
<br />2002, December 18, 2002 and December 24, 2002, the last publication being at least ten (10) days
<br />but not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
