200300520 <br />(c) all oil and gas rights and profits, water rights and water stock of Truster with <br />respect to the Property or any portion thereof; <br />(d) all right, title and interest of Truster in and to any land lying within the <br />right -of -way of any street or highway adjoining the Property or any portion thereof; <br />(e) all right, title and interest of Trustor in and to any and all alleys and strips and <br />gores of land adjacent to or used in connection with the Property or any portion thereof; <br />(f) all right, title and interest of Truster in and to any and all buildings, fixtures, <br />improvements, and appurtenances now or hereafter erected on or affixed to the Property or belonging <br />thereto (the "Improvements "); <br />(g) all right, title and interest of Truster in and to any and all present and future <br />contracts and policies of insurance which insure the Property and the Improvements, or any fixtures <br />or personal property described below, against casualties and other hazards or contingencies, and all <br />monies and proceeds and rights thereto which may be or become payable by virtue of any such <br />insurance contracts or policies; and <br />(h) any and all awards made for the taking by eminent domain, condemnation, or <br />by any proceeding or purchase in lieu thereof, of the whole or any part of the Property, including, <br />without limitation, any award resulting from a change of grade of streets or for severance damages <br />(all of the foregoing conveyed to Trustee herein collectively referred to as the "Trust Estate "). <br />FOR THE PURPOSE OF SECURING: <br />(a) The payment of the indebtedness evidenced by the Promissory Note of Truster <br />dated even date herewith in the Principal Amount and payable to the order of Beneficiary (the <br />"Note "), together with Interest (as defined in the Note) and pursuant to the terms and conditions set <br />forth therein, which by this reference are incorporated herein, together with any and all <br />modifications, extensions and renewals thereof; and <br />(b) The performance of each agreement and covenant of Truster herein contained <br />or contained in the Note (items (a) and (b) hereinafter jointly referred to as the "Obligations "). <br />1. DEFINITIONS. Any capitalized term not otherwise defined herein shall have the <br />meaning, if any, ascribed to it in the Note. <br />2. REPRESENTATIONS, WARRANTIES, AND COVENANTS OF TRUSTOR. To <br />protect the security of this Deed of Trust, Truster hereby makes the following representations and <br />warranties to Beneficiary and covenants and agrees as follows: <br />(a) Payment or Performance of Obligations. Truster shall timely pay all <br />Obligations and Truster shall otherwise fully perform under and comply with the terms and <br />conditions of this Deed of Trust and the Note. <br />0013]]SA <br />-2 <br />
