200300520 (c) all oil and gas rights and profits, water rights and water stock of Truster with respect to the Property or any portion thereof; (d) all right, title and interest of Truster in and to any land lying within the right -of -way of any street or highway adjoining the Property or any portion thereof; (e) all right, title and interest of Trustor in and to any and all alleys and strips and gores of land adjacent to or used in connection with the Property or any portion thereof; (f) all right, title and interest of Truster in and to any and all buildings, fixtures, improvements, and appurtenances now or hereafter erected on or affixed to the Property or belonging thereto (the "Improvements "); (g) all right, title and interest of Truster in and to any and all present and future contracts and policies of insurance which insure the Property and the Improvements, or any fixtures or personal property described below, against casualties and other hazards or contingencies, and all monies and proceeds and rights thereto which may be or become payable by virtue of any such insurance contracts or policies; and (h) any and all awards made for the taking by eminent domain, condemnation, or by any proceeding or purchase in lieu thereof, of the whole or any part of the Property, including, without limitation, any award resulting from a change of grade of streets or for severance damages (all of the foregoing conveyed to Trustee herein collectively referred to as the "Trust Estate "). FOR THE PURPOSE OF SECURING: (a) The payment of the indebtedness evidenced by the Promissory Note of Truster dated even date herewith in the Principal Amount and payable to the order of Beneficiary (the "Note "), together with Interest (as defined in the Note) and pursuant to the terms and conditions set forth therein, which by this reference are incorporated herein, together with any and all modifications, extensions and renewals thereof; and (b) The performance of each agreement and covenant of Truster herein contained or contained in the Note (items (a) and (b) hereinafter jointly referred to as the "Obligations "). 1. DEFINITIONS. Any capitalized term not otherwise defined herein shall have the meaning, if any, ascribed to it in the Note. 2. REPRESENTATIONS, WARRANTIES, AND COVENANTS OF TRUSTOR. To protect the security of this Deed of Trust, Truster hereby makes the following representations and warranties to Beneficiary and covenants and agrees as follows: (a) Payment or Performance of Obligations. Truster shall timely pay all Obligations and Truster shall otherwise fully perform under and comply with the terms and conditions of this Deed of Trust and the Note. 0013]]SA -2
