SCHAGER, being first duly sworn on oath, deposes and says: <br />I am an Abstracter and Title Insurance Agent for Grand Island Abstract, Escrow & Title <br />Co. Licensed in the State Nebraska and have searched the records in the Register of <br />Deeds Office in Hall County, Nebraska and state as follows: <br />On March 11, 1964 Anna C. Shafer, widow conveyed Title to Raymond M. <br />Dibbem and Olga D. Dibbem, husband and wife by Joint Tenancy Warranty Deed <br />filed March 13, 1964 in the Register of Deeds Office in Book 144, page 353 . The <br />Property was described as follows: That part of Lot One (1), Block One Hundred <br />Twenty Nine (129), Koenig & Wiebe's Addition to the city of Grand Island, Hall <br />County, Nebraska, not heretofore conveyed by Grantor described as: <br />Commencing at a point on the easterly line of said Lot 1 which point is 41.65 feet <br />northerly of the Southeast comer of Lot I and established with an iron stake and <br />which is the point of beginning; thence westerly, parallel to the south line of Lot <br />1, 46.9 feet to the east edge of a brick surface; thence southerly, along the brick <br />surface 2.0 feet to the comer of intersection brick surfaces; thence Westerly, <br />parallel to south line of Lot 1, 5.10 feet; thence southerly, parallel to the west line <br />of Lot 1, 6.40 feet; thence westerly parallel to the south line of Lot 1, 10.40 feet to <br />an iron stake on the Westerly line of Lot 1, (the foregoing being the northerly <br />boundary of that tract heretofore conveyed by deed recorded in Book 126 of Deed <br />Records, page 323), thence northerly on and along the west line of Lot 1, 44.75 <br />feet to a point 56.0 feet south of the Northwesterly comer of said Lot 1, thence <br />easterly on a line 56.0 feet southerly of and parallel with the northerly boundary <br />line of said Lot 1, (being the Southerly line of a tract conveyed by deed recorded <br />in Book 132 of Decd Records, page 409) to the easterly line of Lot 1, thence <br />south, on and along the easterly line of Lot 1, 34.35 feet to the point of beginning <br />subject to the terms and conditions of a certain agreement recorded in Book 9 of <br />Miscellaneous Records at page 457. <br />2. On April 24, 1993 Janet E. Snow, Personal Representative of the Estate of <br />Raymond M. Dibbem, deceased conveyed Title to Dixie L. Christensen, a single <br />person by Personal Representative's Deed filed May 14, 1993 in the Register of <br />Deeds Office as Document No. 93- 103898 and on December 12, 2002 LaVonne <br />E. Knuth, Personal Representative of the Estate of Dixie L. Christensen, deceased <br />conveyed Title to Lois A. Hank by Personal Representative's Deed filed <br />December 27, 2002 in the Register of Deeds Office as Document No. 200214565. <br />There was an error in typing the legal descriptions of the two Deeds and infact <br />should of read as follows: That part of Lot One (1), Block One Hundred Twenty <br />Nine (129), Koenig & Wicbe's Addition to the city of Grand Island, Hall County, <br />Nebraska, not heretofore conveyed by Grantor described as: Commencing at a <br />point on the easterly line of said Lot 1 which point is 41.65 feet northerly of the <br />Southeast comer of Lot I and established with an iron stake and which is the <br />
