Bellamy and Bonnie S. Bellamy, husband and wife, GRANTEES, a Right of First Refusal and <br />Option to Purchase the following described real estate (as defined in Neb. Rev. Stat. Sec. 76 -201) <br />in Hall County, Nebraska: <br />The Northwest Quarter (NW1 /4) of Section Twenty Three (23) <br />Township Twelve (12) North, Range Twelve (12), West of the 61 <br />P.M., Hall County, Nebraska, excepting that tract conveyed in the <br />Deed filed on February 2, 2004, as document #200400978, with the <br />Hall County Register of Deeds. <br />The above tract of land contains seventy four and 98/100 acres (74.98) more or less. <br />The parties hereto entered into a sale and purchase of real estate in January of 2004, wherein <br />Diana Church and Maxine Church granted John and Bonnie Bellamy a right of first refusal on <br />Grantor's interest in their remaining farm real estate. In consideration of the purchase and sale of real <br />estate in January of 2004, the mutual benefits to each party and the money paid therein; and other <br />good and valuable consideration, receipt of which is hereby acknowledged, Grantor hereby grants <br />said right of first refusal and option under the following terms and conditions: <br />1. Before Grantor can sell, transfer or convey such real estate, they must first offer said <br />property to Grantee in writing. Grantee shall have sixty (60) days to exercise said right of first refusal <br />and option. The Right of First Refusal and Option may be exercised by the Grantee delivering, by <br />hand or certified United States mail, return receipt requested, a Notice of Exercise of Right of First <br />Refusal and Option. At that time, Grantor and Grantee shall enter into a standard real estate contract <br />for the purchase of said real estate. <br />2. The purchase price for said real estate shall be its appraised agricultural value. <br />3. Said purchase price shall be paid in cash or certified funds at the time a deed to the <br />property is delivered to Grantee. <br />4. This Option and Right of First Refusal shall not be assigned without the written <br />consent of the Grantor. <br />5. This is the full and complete agreement between Grantor and Grantee, and all other <br />agreements, written or oral, are incorporated herein. <br />6.
