200412251 <br />24. Additional Charges. Borrower agrees to pay reasonable charges as allowed by Applicable Law <br />in connection with the servicing of this loan including, without limitation, the costs of obtaining tax <br />searches and subordinations. Provided, however, that nothing contained in this Section is intended to <br />create and shall not be construed to create any duty or obligation by Lender to perform any such act, or to <br />execute or consent to any such transaction or matter, except a release of the Security Instrument upon full <br />repayment of all sums secured thereby. <br />25. Occupancy. Borrower shall occupy, establish, and use the Property as Borrower's principal <br />residence within 60 days after the execution of this Security Instrument and shall continue to occupy the <br />Property as Borrower's principal residence for at least one year after the date of occupancy, unless Lender <br />otherwise agrees in writing, which consent shall not be unreasonably withheld, or unless extenuating <br />circumstances exist which are beyond Borrower's control. <br />26. Borrower's Loan Application. Borrower shall be in default if, during the Loan application <br />process, Borrower or any persons or entities acting at the direction of Borrower or with Borrower's <br />knowledge or consent gave materially false, misleading, or inaccurate information or statements to Lender <br />(or failed to provide Lender with material information) in connection with the Loan. Material <br />representations include, but are not limited to, representations concerning Borrower's occupancy of the <br />Property as Borrower's principal residence. <br />27. Rules of Construction. As used in this Security Instrument, words of the masculine gender shall <br />mean and include corresponding neuter words or words of the feminine gender. Words in the singular <br />shall mean and include the plural and vice versa. The word "may" gives sole discretion without any <br />obligation to take any action. <br />28. Riders to this Security Instrument. If one or more Riders are executed by Borrower and <br />recorded together with this Security Instrument, the covenants and agreements of each such Rider shall be <br />incorporated into and shall amend and supplement the covenants and agreements of this Security <br />Instrument as if the Rider(s) were a part of this Security Instrument. <br />29. Homestead. You waive all right of homestead exemption in the Property. <br />30. Request for Notices. Borrower requests that copies of the notice of default and sale be sent to <br />the Borrower's address which is the Property Address. <br />REQUEST FOR NOTICE OF DEFAULT <br />AND FORECLOSURE UNDER SUPERIOR <br />MORTGAGES OR DEEDS OF TRUST <br />Borrower and Lender request the holder of any mortgage, deed of trust or other encumbrance with a lien <br />which has priority over this Security Instrument to give Notice to Lender's address set forth on page one <br />of this Security Instrument, of any default under the superior encumbrance and of any sale or other <br />foreclosure action. <br />Borrower Initials � % <br />GMD Nebraska Junior Lien DOT - HC Form 33703.3 05/17/02 (page 12 of 13 pages) <br />
