<br />LICENSE AGREEMENT
<br />This License Agreement is made by and between the CITY OF GRAND ISLAND,
<br />NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and QWEST
<br />COMMUNICATIONS, INC., a corporation, hereinafter referred to as the "Licensee."
<br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set
<br />forth the terms and conditions under which the Licensee may construct, maintain, repair, and
<br />utilize the following described improvement which will infringe upon real estate owned by the
<br />Licensor:
<br />Construction, maintenance and repair of a 15' x 20' concrete pad to be used as a
<br />foundation for telecommunication equipment. Such concrete pad to be located on
<br />Lot One (1), Castle Estates Subdivision in Grand Island, Hall County, Nebraska,
<br />as shown on the drawing dated March 9, 2004, attached hereto and incorporated
<br />herein by this reference.
<br />2. LOCATION OF ENCROACHMENT. The Licensee shall install the said
<br />concrete pad on Lot One (1), Castle Estates Subdivision in the City of Grand Island, Hall
<br />County, Nebraska; the specific location of the concrete pad shall be as follows:
<br />Beginning at a point on the east line of said I:ot One (1), said point being Fifty
<br />(50.0) feet north of the southeast corner of said Lot One (1); thence running
<br />northerly, along and upon the east line of said Lot One (1), a distance of Twenty
<br />(20.0) feet; thence deflecting left 90 °16'32" and running westerly, parallel with the
<br />south line of said Lot One (1), a distance of Fifteen (15.0) feet; thence deflecting
<br />left 89 °43'28" and running southerly, parallel with the east line of said Lot One
<br />(1), a distance of Twenty (20.0) feet; thence deflecting left 90 °16'32" and running
<br />easterly, parallel with the south line of said Lot One (1), a distance of Fifteen
