LICENSE AGREEMENT <br />This License Agreement is made by and between the CITY OF GRAND ISLAND, <br />NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and ROBERT W. <br />RUPP and MARY E. RUPP, husband and wife, as owners, hereinafter referred to as the <br />"Licensees." <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set <br />forth the terms and conditions under which the Licensees may construct, maintain, repair, and <br />utilize the following described improvement which will infringe upon right -of -way held by the <br />Licensor: <br />Placement of a monitoring well by Array Environmental, Inc. in the City's right of <br />way between the sidewalk and North Broadwell Street near 1124 N. Broadwell <br />Street in Grand Island, Nebraska as shown on the attached drawing. Said <br />monitoring well shall be flush with surrounding property. <br />The exact placement of such monitoring well on the property identified above <br />shall be coordinated with the Licensor's Public Works Department. Sanitary sewer <br />is presently located at the west curb line on Broadwell Avenue. <br />The legal description of the property adjacent to where the monitoring well will <br />be installed is Lots Fifteen (15) and Sixteen (16), Block Six (6), Boggs and Hill <br />Addition to the City of Grand Island, Hall County, Nebraska. <br />2. LICENSEES' DUTIES AND RISKS. It is understood and agreed that the <br />Licensees may construct, maintain, repair and utilize the above described improvement at the <br />Licensees' sole risk. The Licensees hereby waive any claim for damages against the Licensor, its <br />officers, employees, agents and independent contractors for any damage or injury that may result <br />to said improvement.
